Complaint Review: Capital One Bank

Capital One Bank ripoff, continue to charge me a monthly user's fee though account was closed 8 months ago Richmond Virginia

For years I had a Capital One Visa card, but last January (2004) I cancelled it. After that I was never able to sign on to the website. Every time I entered my account number to log in, I got a message: "account number is invalid." There is no way to get past this automated message.

Nevertheless, I continue to get statements from
Capital One, which charges $6 a month for every month the account is open. The charges are now up to $162.61 and they are threatening to turn me over to collection. I wonder if I am the victim of identity theft?

Today I spoke to Capital Bank and we worked out a solution amicably. They are to send me a new statement with the charges on it. I will pay the legitimate ones and the rest (penalties and fees) they will "take care of." We'll see what happens.

From Capital One's own website (as of the date and time of this post):

"Billing errors can be corrected.

The Fair Credit Billing Act protects you in billing disputes with card issuers and certain other creditors. If you think you have found an error, write to the billing dispute address on your statement. You must contact your card issuer within 60 days after they send you the first bill containing the error. You do not have to pay any amount in question during the investigation, but you are still obligated to pay any undisputed charges.
Your card issuer is legally obligated to acknowledge your letter within 30 days and must either correct the error or explain it to you in writing within two billing cycles."
