In April of 1999, I Paid Off my Credit Card and Closed my account. However, Capital One Bank started billing me for a past due fees and finance charges.

In July of 1999, I contacted them and explained again that this was paid off in April of 1999 and there shouldn't be any other fees on my account. They agreed and credit my account with the appropriate adjustments to zero out and close my account. However, the same day Capital One Bank made the adjustments they had also added another past due fee and finance charges to my account, which started the fraudulent charges all over again. Capital One Bank, that my request to close my account was recieved, but won't be closed until I have a zero balance. I have this above mentioned statement for verification.

I have tried repeatly ever since to get this taken care of. In fact, I had credit collectors calling, who agreed that I didn't owe the money either and would inform Capital One Bank. The credit collectors never called me or sent any other letters to collect this account, because they knew that it was in error.

Know this Capital One Bank credit card shows up on my credit history as a Profit & Loss Writeoff and Charged Off As Bad Debt. How do I ever take care of this? This has been affecting my credit for over 5 years and I am really sick of it and want to do something about it, but not sure what I can do? Can I ever repair my credit, when someone fradulantly and negatively has an impact like this?

I started sending Capital One Bank's customer service website on June 08, 2004 thru June 14, 2004 hundreds & hundreds of times...

On June 14, 2004, I recieved a phone call from Autumn Bonsall from Capital One Bank, stating that she corrected my account, updating the credit bureaus with the corrected information, and how sorry Capital One Bank was for the errors.

It will be a few weeks before I can get an update from the credit bureaus, so I will wait for proof before I actually trust that Capital One Bank has finally corrected my account.

Thank you for your letters of advice. But the best advice that I can give, Is if you have problems with credit cards, find their customer service website/e-mail and just continue to send them e-mails repeatedly everyday. You jam up their website and they get tired of hearing from you.

The trick I did was, type a new letter everyday and then continue to forward the same letter repeatedly throughout the day.

Wow, you're not gonna believe this one either.

My fiance' suddenly got a Capital One card in the mail about 1 years ago, and he never even signed for it. I had just moved to Iowa because we were to be married. Now, follow me here.........

I had a Capital One card several years ago that I promply cancelled because the finance charges alone were phenomenal, just for 'owning' the card. They were killing me, and even after I cancelled, it was as if it was totally ignored. I had just gone through a divorce, and was having a credit problem or two as it was, so I didn't need their crapola.........

And here's what struck me as odd:

If you fill out the online form for the card, they can approve you within a minute or so, and then, they'll go ahead, ONLINE, and give you your card number, and within 5 minutes, you're off and using the card anywhere on the net that you choose.

When I encountered this, I thought, 'Holy GOD, man......ANYONE could use MY personal information, apply online, get a credit card, and totally ruin me without me even knowing it.' They may have changed this by now; I have no clue~

So back to the fiance'.....he lived in an apartment, and we were in the process of finding a house, and he had a neighbor who was caught stealing our mail right before we moved~ we filed reports on him, thus resulting in a warrant for his arrest~ felony mail theft and forgery..........well, get this..............the fiance' started getting bills out the buttola from Capital One.

One bill came that had well over $230.00 just in 'owning' charges basically, and then, there was a charge for $153.00, for two posters. Now keep in mind, he wrote them and said he didn't even WANT the card, and cancelled it..........we figured that was the end of it, and for months, we'd get things from them, offering us this, offering us that, other credit cards, and we'd ditch them all without opening them~ and evidently within that mess of crap they were sending us? Was also a bill, and every month, more charges and more charges were added onto it, and we didn't even KNOW it, because he had CANCELLED THAT CARD.

Hell, he didn't even sign anything~ NOTHING in writing, for the card in the first place! (Evidently, Capital One is just happy with any ol' electronic signature they can get.)

Soooooooooooo~ to make a long, really horrid story short, even after calling them, pleading with them, the whole gambit, one night, a man showed up at our door, asked if my fiance' lived there, and served him with papers.........

And, the fiance' called them AGAIN! And they referred him to the collection agency/lawyer they use, so he then called them, explained the situation, and they wouldn't even negotiate him making a small payment just to get them off his back!

They've ruined his credit, and, the sweet part?
This went to the local courthouse, and now, he's got a judgement against him, and guess how much the total is, for $153.00 in 2 posters he didn't even order, and finance charges?

He's stuck owing them over ELEVEN HUNDRED DOLLARS.

He didn't even order the card, he didn't even sign for the card, he didn't even personally use the card, and now, he's screwed, and screwed deep.

Another fine example of American business at work~

Hi again Lisa,

Sorry to hear about the situation with the bureaus. Do you have any of the monthly statements showing the adjustments and such? If so, it should be a relatively easy situation to resolve if you can speak with a super. Even then, you may ask to speak with their manager, who may, if escalated enough, go to the executive response group.

Otherwise, in all honesty, after about 7 years, the bureaus will usually drop the info off of your reports. But this would be from the last reporting made by the company. So, if they did so in July of 99... and there hasnt been any additions of delinquency since then, youre not too far off from that 7 year mark. Thats really the best info I could offer. Hope things work out for you though!

Hi;
I have already tried the route of using the credit bureau reporting agency dispute. With even worse results.

After I disputed it using the credit bureau Capital One Bank, then added Charged Off as Bad Debt & Profit and Loss Writeoff.

Hi Lisa,

Sorry to hear about your problems. I can assure you that sometimes, there are not the best of associates at Capital One. Most have the best of intentions. It is the company's policy to basically kiss customer butt. Trust me, i know this for a fact. So it was most likely just someone not doing their job at looking at the account in full. What you could do is contact customer relations and ask for a supervisor. The supervisor will be the best bet of getting this resolved, because if they cannot fix the issue, they can move it up to the Escalated Response group. All it is, is a simple form disputing your credit bureau reporting that would need to be submitted. Also, you may wish to try and use the dispute form that you received with your credit bureau report and submit it directly with the bureau. Typically, the bureaus submit the dispute to have verified with the company in dispute. This will typically get the proper reporting to appear. So what you may wish to do, is contact an account supervisor first to submit the credit bureau reporting investigation, and then about 30 days after that, submit the dispute form to the bureau directly.
