Capital One ripoff contiues to charge me late fees and over the limit fees Seattle Washington

I am not sure if it is the Seattle office or Richmond office. My ex husband and I got a credit card from Capital one in 1996 after buying our house. Our credit limit was $500.00. In early 1997 my husband got laid off and was out of work for 11 mo's. We got behind in our payment and eventually stopped making payments.

We continued to get statements from them charging us over the limit fees and late fees. In 2003 we divorced and my ex continues to receive statements. Our credit limit was only $500.00 but the balance is now close to $3000.00.

Capital one continues to send statements, they report the balance as "paid as agreed" on our credit report, but it is obivious that we aren't paying because the balance is going up not down each month. This has been going on for over 6 years and they have yet to send it to an agency.

My ex contacted them and asked them to do a settlement and they won't. They say they won't close the account until it is paid in full. I don't understand why they aren't closing the account. I want to get this off my credit as it affects my score, but refuse to pay them $3000 for a $500 credit limit. I have probably already paid them about $1000 total before we stopped completing paying.
