Many banks do this! Here is what happened.

Jimmy,

Cancelling one card and re-opening another with the same bank will in most cases allow preauthorized debits to move from one to the next. AMEX is famous for this as are the big ones like Chase, CitiBank, Capital One, etc.

The only way to stop unauthorized charges is to totally cancel the card and NOT re-open one with the same bank for at least 2 billing periods. In that time all preauthorized charges will be cancelled.

Go to a different card issuer. No problem.

File a Complaint with your Attorney General's Office Website

Your Chargeback Rights!!

Be aware that many customer service representatives are not familiar with claims and defenses.

Some representatives have denied valid claims and defenses which otherwise meet all of the requirements on grounds that the letter was not received within 60 days, or that the merchant has filed for bankruptcy, or that the merchant bank refuses to pay back the card issuing bank because the time limits regulating dealings between the banks under Visa or MasterCard regulations have expired. None of these are proper or legal grounds for denying a valid claim for a chargeback under your "claims and defenses" rights.

If you are writing your letter to the bank more than 60 days after the charge you are disputing first showed up on your credit card bill, you may want to clearly explain that you are asserting your "claims and defenses" rights under state and federal law, which, unlike "billing error" rights, are not limited to being asserted within the 60 day time frame.

In the event your bank denies your request and you believe that you have satisfied all of the required conditions, you can file or make a complaint with the Attorney General's Office Website.

Capital One exploits data mining for direct marketing, among other activities.

#10Consumer Suggestion

The reason Capital One will use is that the authorization attaches to the account holder and not the account itself. They will claim that you need to cancel the authorization with the company.

The truth is that Capital One uses the Credit Card business as a front for their real intended purpose which is to sell and market your personal information with their advanced data mining techniques.

Here's verification of what I am referring too.

"Data mining companies will need to form partnerships and team up with firms that can provide the expertise and information they lack. On the other hand, an interesting example of what is happening is the company, Capitol One," said Montgomery.

A Falls Church, Va., holding company, Capital One Financial Corp. owns Capital One Bank, one of the major issuers of MasterCard and Visa credit cards in the country. Yet the description on its Web page profiling the company sounds very much like a firm exploiting the potential of data warehousing and data mining for direct marketing, among other activities.

Thus, "Capital One has grown dramatically due to the success of its proprietary information-based strategy, which combines advances in information technology and sophisticated analytical techniques to identify, manage and take advantage of business opportunities."

Montgomery's point is that here is a company ostensibly in the credit card business that sees itself as an information technology company, using data mining techniques for marketing. He feels this may be a more familiar scenario in the future.

They are a bunch of crooks, so your best bet is to try to go over their head directly with Visa.

VISA'S Zero Liability has you covered

#10Consumer Suggestion

Fri, August 04, 2006

You have protection for this kind of problem directly from VISA. You can call them at (800) 847-2911

It's simple. Shop online and off with absolutely no risk
Use your Visa card to shop online, in a store, or anywhere, and you're protected from unauthorized use of your card or account information. With Visa's Zero Liability policy*, your liability for unauthorized transactions is $0you pay nothing.

Zero Liability has you covered
Worry-free shopping
Ultimate security
Complete fraud protection
Owe nothing on fraudulent transactions

Visa's Zero Liability policy means 100 percent protection for you. Visa's enhanced policy guarantees maximum protection against fraud. You now have complete liability protection for all of your card transactions that take place on the Visa system. Should someone steal your card number while you're shopping, online or off, you pay nothing for their fraudulent activity.

If you notice fraudulent activity on your card, promptly contact your financial institution to report it. It is important to continually monitor your monthly statement to identify any unauthorized transactions.**

Visa's Zero Liability policy took effect April 4, 2000, and is a great improvement on the previous policy. The former policy required that you report fraudulent activity within two business days of discovery. After this two-day period, you could be held responsible for up to $50 of the unauthorized charges. With the new Zero Liability policy, you're no longer required to report fraudulent activity within two days and you're not responsible for any fraudulent transactions made over the Visa network.

The Zero Liability policy covers all Visa credit and debit card transactions processed over the Visa networkonline or off. The only transactions not covered under the Zero Liability policy are commercial card, ATM, and non-Visa-branded PIN transactions.

For transactions on other networks, the liability decision is left to the financial institution that issued your card. The issuer has the option of extending the same protections afforded by Visa's Zero Liability policy.

Get quick provisional credit for fraud losses
Visa's cardholder protection policy requires all financial institutions issuing Visa products to extend provisional credit for losses from unauthorized card use within five business days of notification of the loss. However, many major financial institutions affiliated with Visa will issue provisional credit even earlierwithin 24 to 48 hours after the loss is reported.
