I was very happy with the company. The sales consultant and designer, Natalie Llana, was very patient and not at all pushy. Their construction is very good, all subcontractors were very competent and had very good things to say about their prior interaction with the company. The owner, Greg Luce, had been in the business for over 30 years. Post-construction support was all very good.

Until sometime around July 1. At that point, the company closed shop.

I paid them their last check on May 7, 2008 as per the contract. Now, in July 2008, I have received letters from 4 subcontractors that they have not been paid yet. I have also not received the pool vacuum that was part of the contract.

This is strange. Subcontractors claim that Florida laws give them the right to go after my home to collect their dues. But I have no way of forcing Capital pools to pay them. I am not even able to reach the company or the owner, Greg Luce, by phone any more.

I don't understand why my responsibility does not end with my payments to my pool company. I was not involved in negotiations with the subcontractors. I didn't even know about them until they showed up to do the work. Shouldn't they have some kind of insurance against these kinds of failures? Why should I have to pay twice?

I can't think of any other case where a buyer may be liable to pay twice because somebody else messed up. I am trying to explore my options.
