Capitol One Auto Finance ripoff, repossed car before notice and stold my childrens carseats Long Beach California

Last year my husband and I both lost our jobs, that is when we got behind on our car payments, Capitol one would not discuss deffering car payments just kept adding lait fees. We both have new jobs now but were unable to catch up on car payment I received a notice that on 10-19-2006 that the past due balance was due but no notice of repossesion, on 10-09-2006 my car was repossesed.

I called capitol one on the morning of 10-10-2006 at 9:00 am to see if I could get my childrens 2 car seates bact I was told to call Milenium recovery 1-800-914-8761 who then told me to call Tri state auto recovery of oklahoma 1-918-787-4323 I called them at 9:24 AM They said they would let me get my car seats but I had to meet them in 30 minutes at a truck stop I said I didnt want to meet them there .

They said that if I didntd meet them in 30 minutes that I would have to drive from Tulsa to Grove ok about 2 hours away then they decided they would meet me at the Cracker barrel at 31 and memorial.

When I got there my car seates were not in the car or the blankets I use to cover up my babies when Its cold the guy that repoed my car said that they werent in there when he picked it up but they offered to give me some used car seates the next time they were In town I declined and left

I am an ex employee of COAF and there is no way you can say that you had no idea you were about to be reposessed. COAF calls people up to 15 times a day to let you know where your account stands and to try and work out a payment plan with you. I think you need to go ahead and tell the whole story, not just what you want people to belive.

Check the laws in your state. In most stated, the vehicle may be repossessed, without notice, as long as there is no breach of the peace. This is why most repo companies will come as a "thief in the night" and take the vehicle when you are sleeping or from your workplace. If you were present and protested, legally, they breach the peace if the continue the repossession.

In almost ALL cases the personal property within the vehicle MUST be returned to you. It is not unusual for the repo company to claim nothing was in the vehicle. If you can prove the car seats were present, or convince a law enforcement officer, and press the matter you will likely get them back or be compensated by the repo company. Taking items from a repossessed vehicle that belong to the owner is usually considered "theft by conversion".

You were told you were behind in your car payments. On 10-19-06 you received a notice that the past due balance was due. In a round about way, they were telling you they were gonna repo your car. They repoed your car. You state it was 10-09-06, I guess you got your dates mixed up.

Maybe 9-19-06 is when you got the notice? You called cap one, then the repo company about the car seats. They gave you 30 minutes to go and pick them up which YOU chose not to do. Whose fault is that? Whose fault is it that the car payments weren't made?

They don't have your car seats, the repossession company does.
