Complaint Review: Capitol One Bank

I got home after being gone for a few days and answered the phone and it was Capitol One.The Gal stated she needed a payment and I said no problem I will pay you $400 on Thursday morning which was 1.5 days from when I talking to her on the phone.She stated that would be fine because they will be issuing the account to the collection department for asssignment of car.This was about 1:00 on Tuesday and at about 3;30 a tow truck hooked up my Pontiac car and said he's taking the car per Capitol One.I stated I just got off the phone with them and was paying the payment on Thursday Morning.He said I would need to call them and verify the agreement with him on the phone to agree not to take the car.The Gal on the phone from Capitol One said if a Towing company hooked up the car it was too late to pay any money and I would need to speak with another department at the Bank and work out the details but it could take a while to get the problem resolved.So the driver left with the car behind  the Tow Truck and I spoke with yet another person at the bank.This Gentlemen said someone already authorized pick-up of the car and it was just too late.I said your not honoring the previous agreement 3 hours ago and he said it's too late and now I would need to pay tow fees,late charges and payment charges of $1,192.00 before I could get car back.I said that is ridiculas and that my contract after 5.5 years is finished in Febuary of 2011 I plan on paying till that point to get the clear title from Capitol One.Finally I agreed to pay the the $1,192.00 as I still wanted the car and they said thats the only way your going to get the car back.I said I would Western Union the money that day and he said you also now need to send us your wages per month,proof of insurance,and 3 more references in addition to the four I already gave them when I first was financed for the loan 5 years ago which would make 7 references now .I sent the information via fax but would not send the 3 additional references as I refused that part because I never gave 7 references on any loan and wasn't about to start now as they just kept adding more requirements to get the car back.Finally after realizing I'am just not going to be able to get the car back I said "keep the car" and we can settle this in court.Capitol One now has plans on auctioning the car off and depending on the sale price we will see what the difference is regarding payment to me.I told them the car was hit and needed to be repaired and they said that it was too late for that to happen.In the meantime when I wanted my personal property out of the car it was gone and I was told the driver said to remove the property which was a complete lie as I was going to pick the car up in a few hours after I paid Capitol One and untill I ran into this mess with them over the car.These people at Capitol One are liars and don't honor their agreements and I personally think they just wanted the car because it was to be paid off in Febuary of 2011 and they wanted to keep adding charges and make more money on the car at this point.The employees at this bank are rude and obnoxious and dont care what the last person said at the bank because you can never talk to the same person twice as they just wont let you and say they are busy,so you have to talk with many.This bank I have found out now has Thousands of complaints and the Attorney General is even involved in their practices in the state they operate.Will let you know the outcome as I'am sure this will end up in court at some time in the near future.Watch this bank and be very careful if you have an account with them.
