I have three different Capital One accounts with this company. All accounts are secured with $500 credit limits, which means I paid $250 cash to actually open the accounts. All three accounts are now in collections with three different collection companies, Alliance One, Aarow Finance and another company.

One representative, Frank Darson, has continuously harrassed me at work and has even made threatening remarks about "blacks" not paying their bills on time and advised that he would go after my paycheck in order to receive the balance.

I have been reprimanded a few times at work concerning the numerous phone calls, and he has even gone so far as to verify employment with the Payroll Division of my department.

Now my balances are $1600, $1200 and $600 and these include late charges, plus over the limit fees.

I am requesting investigation into these accounts. I would like to make settlement offers of $250 on each account and pay them off in full, or either be considered in the Class Action Law suit if at all possible.

Help, I'm getting sick and tired of all the pressure from the collection agencies, and am seeking your advice.

First, advise the collection agencies in writing (fax or mail certified return receipt requested) that they cannot contact you at work. Second, get a tape recorder. When they call, tell them that you are recording everything. Or, even better, ask an attorney or local district attorney whether it is illegal in your state to secretly tape record conversations. It is legal in many states so long as you are a party to the phone call.

You list numerous potential violations of the Fair Debt Collection Practices Act. If Tennessee protects wages from judgment or collections, then they probably cannot go after your employment income.

At the same time, write Capital One (certified mail return receipt requested) cancelling your accounts.
