Car Mart Majorly dishonest, uncooperative and misleading ripoff Wichita Kansas
I bought a 2001 Kia Rio in June of 2005. In late August the motor went out due to a timing belt. When it was all said and done the mechanic had my car for over a month, and a motor with 14,000 miles was put in. That cost me $1400. Then not even a month later the safety transmission switch went out.
Because I was 2 weeks late on the payment for the car(gee, could it be because I was paying for repairs) they held my car till I could make a payment. I was a high risk pregnancy at this time. And had missed an appointment to my doctor. I ended up having an emergency c-section on October 25th due to pre eclampsia, aggravated by stress. Wouldnt you be stressed if someone had your car and left you with no transportation? My daughter passed away on November 4th 2005. Then I finally got a job starting the day after Thanksgiving. I was then laid off on December 31st, due to 3 call in's due to the fact that the transmission switch once again went out on the car.
Then on January 29th 2006, Car Mart picked up my car from my job, because I was 13 days late on the payment. They said it isnt repossessed, they are just holding it until I make a payment. So in the meantime, I have no way whatsoever to get back and forth to work, and they know this, but they still wont release my car. Its odd that they want their payment, and yet wont let you get back and forth to work so that you have a paycheck to make the payment with.
Needless to say by the time it is all said and done, I have since June paid out around $3000 in repairs and towing fees. And according to other dealerships this car is only worth $2500 at auction, because of how many miles it has on it and its age. So I have put in more money then what this car is worth. And frankly I am majorly fed up. This car was a lemon from the get go. Because on top of everything else, it was making an odd noise when we bought it. Then a couple of month ago the rear wheel bearing went out, and that repair also cost me $325.
Can we say I bought a lemon?? But from what I understand in the state of Kansas it is hard to make the Lemon Law stick. So now I am trying to find a pro-bono attorney to see if I have any case whatsoever against them.

Well, I tried to get rid of the car today, but found out it is only worth $800 for a trade in. And I still owe $6825.23 on it. So the only way I can get rid of the car is to have a strong co-signer. So on Saturday, instead of getting rid of the car, I am going in to update my payment arrangements. So now I get to keep throwing away good money after bad on a vehicle that isnt even worth it. I am reporting them to the Better Business Bureau and to the county attorney here, even though I know they arent going to do anything.
