I have been asking to get Sprint PCS stop trying to collect a bill that is not mine for the past three years. They keep selling it to different collection agencies, RPM, Allied Interstate and now Cavalry Portfolio. To cut the story short, they have no proof that is mine, because it is not mine. It was not even an ID theft. Sprint PCS sold 300,000 account to collection agencies. Got money from them, and continuing to verify to Credit bureaus that is correct. Well, how come they can't send me the verification? Credit Bureaus don't want any proof. They just want a nod.

So I had enough. I am doing something about it. Here is what I am doing, and done:

First I took long breaths. I am not going to let collection agencies run my life. I take 3 long breaths, every time I think of them. I don't want to hate them. They are doing their job. They are teaching me how to fight back when there is no justice.

Second, I decided not to fight them ALONE. I like to get anyone that has problem with them, any fraud that they have committed; I like to know about it. (I will define what a fraud is, and two how to protect yourself.)

Third, when there are enough complaints, especially in my area, I like to sue them in court them, ONE by ONE. No more class action suit where it may take 5 years. Just let them make a trip every time, which they won't do because they know they don't have a case. So let them come to us. I will hire an attorney that will work with us. Did you know that for every fraud, or not following the Fair Credit Act, they will owe us $1000. You read it right. Even if I give my $1000 to a lawyer, I like to see Sprint PCS change their ways. I don't like my fellow Americans Suffer for this. Even when they will delete the collection from my credit agencies, I will still help others get justice done. And believe me, they will delete mine, it could be tomorrow, or it could be in 6 months. But they will delete. Their time is numbered.

Fourth, I am writing a complaint letter to Federal Trade Commission (FTC), Attorney General and Better Business Bureau a letter about how Sprint PCS and Their Collection agencies have acted dishonestly. I would put everyone's name that sends me an email You may give your name and account # with the Sprint PCS, so they can delete the collection from your credit account, when they realize you will not go away until this is resolved within a short period of time. If you don't feel comfortable about giving your name, that is fine too. I just want to know how many people have problem, add the numbers up, send the agencies your complaints. When they resolve the problem with me, I will send you an email about who to contact to get your collection resolved.

Here are a list of things they may be liable for under Fair Credit Act, :

If you asked them to send you proof of the bill, they don't do it, they are liable (make sure you have proof you asked them for the bill in writing. As a matter of fact, they may always deny talking to you).

If they report to credit agency before giving you a chance to respond to their bill, they may be liable. If they report the same bill twice in any of the Credit Bureaus, they may be liable.

If you sue them in court, and they don't show up to the court, they owe you $1000, Even if they have deleted the collection from your account. Judge would want to know why they didn't show up.
If you sue them in court, and they bring a fake bill to court, that is a fraud. They may be liable for criminal prosecution. Or if the bill does not have your signature on it, it is not valid.

Don't ever send them any personal information. They wanted me to send them my SS#, State and Issued date of Driver's License, a police report that my identity was stolen, and copy of proof of my residence at the time of account was established. They want to use that information against you. Don't let them. Beside, I don't think my ID was stolen. I think Sprint PCS employee just got my name and perhaps used it (I don't even know if there is any phone bill, since they won't send it to me.) and then just charged it to thousands of people like me and you. Beside, I know a woman who send them all of that, it didn't make a difference. They still wanted her to pay after 6 months.

The list could go on. I may add to the list as I get more information from my attorney.

Remember, don't be afraid of them. They are full of air. They may threaten you, but they don't mean it, because they have no bill or signature, and they know it. I didn't have time to get this out of my record, but I do now. That is good for you, since if you don't own the bill, you can get it off. No question about it. So breath easy and deep. Thank them; you may even get paid. And you will know what to do next time someone pulled something like this on you. Be happy.

sprint the wrong choice, in villoation of their contract

In short sprint shut my phone off before the due date on the bill. I checked with a lawyer on this as far as they are concerned that sprint was in villoation of their contract with me bye shutting my phone off and refusing to turn it back on unless I gave them money.

They are also in preach when they failed to send me a thirty notice notice bye law to shut off a phone They also preached the contract when they failed to send me a notice telling me it was now in collections the same day they shut me off. I suggest that sprint when they do business in difrent states look at the laws not all the laws are the same so now I am waitng for sprint to take me to court were I will counter sue the for breaking thease laws. oh yea I forget to mention the lady in the collection department also said that they would accept a post dated check a nother no no in this state.
