Complaint Review: Cavanna Construction

ATTENTION ALL CAVANNA CONSTRUCTION CUSTOMERS,

WE ARE WRITING AN ADDITIONAL REBUTTAL FOR THE MAIN REASON THAT ALOT OF INFORMATION WAS LEFT OUT, ON OUR END. FIRST OF ALL WE ARE GOING TO START WITH A QUESTION. WHEN YOU HIRED A CONTRACTOR AND ARE GOING TO SIGN A CONTRACT DO YOU READ THE CONTRACT? THE ANSWER SHOULD BE YES! I WOULD SAY THAT ALL CUSTOMERS READ WHAT THEY ARE SIGNING, AS DID OUR UNHAPPY CUSTOMER. IN HIS CONTRACT IT CLEARLY STATED A DOWN PAYMENT IS NEEDED AT THE TIME OF SIGNING, AND YES HE DID GIVE A DOWN PAYMENT. HIS DOWN PAYMENT CHECK DID GET RETURNED FOR INSUFFICENT FUNDS. A SECOND CHECK WAS GIVEN TO OUR COMPANY AND THAT CHECK DID CLEAR. WHEN THE CONTRACT WAS FIRST SIGNED THE MATERIALS DID NOT GET ORDERED UNTIL 2 WEEKS AFTER THAT BECAUSE OF THE PAYMENT PROBLAMS.

WE WOULD LIKE EVERYONE TO KNOW, WE ARE NOT THE ONLY COMPANY OUT THERE THAT MAKES SURE THAT CUSTOMERS CHECKS ARE GOOD PRIOR TO ORDERING, THIS IS FOR OUR SAFETY AS WELL AS IT IS THERES. WHEN WE DID GET THAT PROBLAM RESOLVED, WE TOLD THE CUSTOMER THAT IT WOULD BE A NUMBER OF WEEKS BEFORE WE COULD START AND HE WAS FINE WITH THAT. WE TOLD HIM FROM DAY ONE THAT IT IS VERY HARD TO SIGN A CONTRACT AND START THE NEXT DAY, THERE WERE CUSTOMERS THAT HAD SIGNED BEFORE HE DID. WHEN CC DID START THE BASEMENT, THE CONTRACT CLEARLY STATED THAT HE NEEDED TO MAKE WEEKLY PAYMENTS, AND IN ALL HONESTY WE HAVE BANK STATEMENTS TO PROVE THAT HE DID NOT MAKE THE FIRST TWO PAYMENTS ON TIME THE WAS 3-4 DAYS LATE ON EACH ONE. WHEN IT CAME DOWN TO THE THIRD PAYMENT CC THERE WAS NO CHECK AVAILABLE. THAT FRIDAY WHEN THE JOB WAS COMPLETE FOR THAT WEEK, A CHECK WAS ASKED FOR AND WE KEPT GETTING THE RUN AROUND, THAT FOLLOWING WEEK WAS THANKSGIVING WEEKS AND WE NEVER RECIEVED A PAYMENT.

THAT MONDAY AFTER THE HOILDAY THE OWNER OF CC AND 2 EMPLOYEES WENT TO THE CUSTOMERS HOUSE TO PICK UP TOOLS. CC ONLY PICKED UP THERE TOOLS BECAUSE THE CUSTOMER STATED CLEAR AS DAY THAT HE DID NOT HAVE THE FUNDS TO PAY, THAT HE NEEDED TO SELL HIS CAR. THE CUSTOMER ALSO STATED THAT HE HAD TWO CERTIFIED CHECKS FOR CAVANNA CONSTUCTION, WHICH WERE NOT AVAILABLE FOR THE OWNER TO SEE. CC NEVER WANTED TO DISAPPOINT A CUSTOMER, THIS IS NOT HOW WE DO BUSINESS. BUT WE NEED EVERYONE TO UNDERSTAND OUR CONTRACTS ARE VERY DETAILED AND AND WE STICK TO OUR CONTRACTS TO ENSURE OUR SAFETY AND YOURS. THE CUSTOMER ALSO STATED THAT A SIGNED AGREEMENT WAS MADE THE DAY THAT CC PICKED UP THERE TOOLS AND THAT WAS AN UNTRUE STATEMENT. WE DO NOT LIE AND WE DO NOT APPRECIATE ANYONE IMPLYING THAT WE DO. WE ARE VERY UP FRONT AND HONEST. WE HAVE EXCELLENT REFERENCES, AND ALSO ONE ON ONE MEETING WITH CURRENT CUSTOMERS AND POTENTIAL CUSTOMERS. OUR BUSINESS IS SOLELY BASED ON WORD OF MOUTH ADVERTISING AND WE HAVE BEEN DOING VERY WELL ALL THESE YEARS, PRIOR TO THIS CUSTOMER.

I COULD COMPLETELY UNDERSTAND IF WE HAD A SIGNED CONTRACT AND WE DID NOT FOLLOW THAT CONTRACT, BUT WE DID. THE ONLY THING ON OUR CONTRACT THAT IS NOT CONCRETE IS THE TIME FRAME WE HAVE A LARGE OPENING, FOR THE REASON OF ADD ONS OR EXTRAS, ALSO THE UNKNOWNS. WHEN A JOB WOULD NORMALLY TAKE US 4 WEEKS WE GIVE THE TIME FRAME OF 4-6 OR 6-8 WEEKS, PENDING ON THE INDIVIDUAL CUSTOMER AND THE WORK TO BE COMPLETED. IN THIS CASE WE HAD A LONGER TIME FRAME BECAUSE OF ALL THE EXTRAS THAT WERE BEING ADD EVERYDAY. THE COST OF THE JOB WAS ALSO CHANGING DAILY DUE TO THE ADD ONS. ALSO IN DEALING WITH A TIME FRAME, THERE ARE ALSO WEATHER CONDITIONS THAT NEED TO BE FACTORED IN. WE TRUST ALL OF OUR CUSTOMERS, AS WE WOULD HOPE THAT OUR CUSTOMERS TRUST US. DURING THIS PROCESS WITH OUR CUSTOMER WE STOPPED PHONE CONVERSATIONS FOR THE REASON WE DID NOT WANT HE SAID SHE SAID, WE WANTED CONCRETE ANSWERS IN WRITING. DURING ONE OF THE EMAILSHE RESPONDED BACK TO OUR COMPANY AND REWROTE MY INITIAL EMAIL THAT WAS SENT TO HIM. THAT IS JUST ONE WAY THAT WHAT WE HAD PROOF THAT WE WAS NOT WANTED TO PAY.

WE DO NOT LIKE TO TALK BAD ABOUT ANYONE, JUST FOR THE SIMPLY REASON, THAT WE DO NOT WANT IT DONE TO US. SO, WITH THAT BEING SAID WE WOULD LIKE ALL POTENTIAL CUSTOMERS TO REMOVE THESE HARSH, UNTRUE STATEMENTS FROM THERE MINDS. CAVANNA CONSTRUCTION WILL NOT SIGN ANY CONTRACTS WITH ANY CUSTOMERS PRIOR TO A CONPLETE WALK THROUGH, AND LIST OF REFERRALS ARE GIVEN. AGAIN I WOULD LIKE TO STATE WE ARE HONEST AND UP FRONT TO EVERYONE. WE HAVE NOTHING TO HIDE.

I AM WRITING A RESPONSE TO THE COMMENTS THAT WERE POSTED ABOUT MY COMPANY. I AM VERY UPSET AND SURPRISED ABOUT WHAT WAS BEING STATED BECAUSE IT WAS ALL FALSE. WE CONTRACTED THE JOB THE CUSTOMER GAVE US A 10000.00 CHECK THAT BOUNCED, WE WERE CHARGED FEES THAT THE CUSTOMER NEVER REEMBURSED ME FOR.

SECONDLY, WE NEVER GAVE HIM A DEFINATE TIME LINE DUE TO THE FACT I WAS IN THE MIDDLE OF ANOTHER JOB AND I NEED TO ORDER MATERIALS FOR HIS JOB. THIRDLY HE CALLED EVERYDAY TO MAKE USE WE DID NOT RUN AWAY WITH HIS MONEY BECAUSE HE SAID THAT HAD HAPPEN TO HIM BEFORE. I STARTED HIS JOB, AS PER THE SIGNED CONTRACT HE WAS REQUIRED TO MAKE WEEKLY PAYMENTS THE FIRST WEEK HE DELAYED THE PAYMENT 3 DAYS. THE SECOND WEEK THE PAYMENT WAS DELAYED 3 DAYS ALSO. ON THE THIRD WEEK A PAYMENT WAS NEVER RECIEVED AND HE STATED HE WANTED TO PAY IN FULL AT THE END OF THE JOB. IN RETURN I STATED NO BECAUSE IT WAS IN THE CONTRACT, WE WROTE THE CONTRACT THAT WAY FOR CUSTOMERS LIKE HIM. HE DID NOT LEAVE US FEELING SAFE ABOUT DOING WORK WITH OUT PAYMENT AT THE END OF EVERYWEEK.

FROM THE BEGINNING HE CONTINUED TO TELL US HOW LONG IT WAS GOING TO TAKE US TO COMPLETE HIS JOB AND EVERYDAY HE CHANGED THE WORK THAT WAS TO BE COMPLETED.

ALSO, I AM VERY DISTURBED AND UPSET THAT HE WOULD BRING UP MY FAMILY, MY WIFES PRIVATE, PERSONAL LOSS TO THE PUBLIC. I AM REALLY NOT SURE HOW HE WAS INFORMED ABOUT THE SITUATION, ALTHOUGH I FEEL THAT IT WAS VERY IMMATURE AND INAPPROPRIATE TO ADVERTISE THAT TO THE PUBLIC.

SO IN CONCLUSION, HE IS GETTING THE SAME RESPONSE THAT HE RECIEVED WHEN HE CONTACTED THE OTHER COMPANYS. WE DID NOT BACK OUT ON HIS JOB, WE HAD EVERY INTENTION OF COMPLETING THE PROJECT, WE JUST NEEDED HIM TO COMPLY WITH THE CONTRACT THAT HE SIGNED, IF HE DID NOT AGREE WITH THE PAYMENT TERMS THEN HE SHOULD NOT HAVE AGREED TO THE CONTRACT. THE MATERIALS WE LEFT AT HIS RESIDENCE, AND CAVANNA CONSTRUCTION HAS PROOF OF MATERIALS PURCHASED AND PROOF OF DELIVERY.

THIS CUSTOMER IS TRYING TO SCAM OUR COMPANY, HE TOLD OUR EMPLOYEES THAT HE NEEDED TO SELL HIS CAR IN ORDER TO GET HIS BASEMENT REMODELED. I AM A YOUNG CONTRACT BUT I AM NOT STUPID. I KNOW MY RIGHTS AND I ALWAYS HAVE PROOF TO BACK UP MY STATEMENTS AND WORK THAT I COMPLETE. THIS CUSTOMER HAS BEEN GIVING US PROBLAMS FROM DAY ONE. YOU CAN MAKE YOU OWN OPINION ABOUT MY COMPANY, BUT PLEASE JUST REREAD HIS COMPLAINT, WHAT KIND OF INDIVIDUAL WOULD PUBLICALLY ADVERTISE SOMEONE ELSES PERSONAL LOSS, AND REFER TO EVERYTHING AS A LIE.

Here is our complete story of how we got into this big mess. Phase I: Hiring Cavanna Construction and Making First Payement. It was second week of july we received a flyer from the TheaterXtream about the hometheater. Since I wanted to have nice hometheater in my basement for long time, I decided to visit the TheaterXtream store in LeesPort PA.

After visiting the store, I decided to purchase their home theater. The requirement to complete the home theater was to have finish basement and my basement was not finished. So I asked TheaterXtream if they know someone who can finish the basement and they recomended us Cavanna Construction. Cavanna Construction contacted me to provide me an estimate on my basement. I made an appointment with Cavanna Construction to come to my house to give me an estimate. They came to my house to masure my basement in third week of july. Cavanna Construction gave me an estimate on 1600 SF basement.

This is their first lie. Based on the masurement, the basement was just little over 1500 SF but they gave me estimate on 1680 SF @ $25 pr SF. Total was $42000. After the TheaterXtream dicount the total was $33600. This total included all materials and labor. The total was little over my budget so after some negiotition it was decided to finish the basement + patio(Patio was verbal acceptance from Cavanna) for $31640.I was to pay $16000 first and then four payment of $3910 once the work starts for 4 weeks. According to the contract I was to make first payment of $16000 which I did by using Discover Check. The bank rejected this check as there was limitation and as soon as I found out that the check was rejected by bank I called Cavanna Construction to make the arrengements to give them another check and I also said that if their bank has charge any fees, I do not have problem paying that. I made an arrengements and paid them $16000. I have attach copies of those check.

Now this is what Cavanna is complaining that I gave them BAD check. Did I corrected my mistake in timely manner? Yes I did. Once the payment of $16000 was made, Cavanna Construction did not start the project for another 10 Weeks when they promised to deliver my basement in 8 Weeks. They never communicated me regarding the status of the project. I had to call them every time to find out what is going on and that too after some time they stoped responding to my calls as well as voice mail. I had to go through TheaterXtream to find out what is going on. During the time of estimate, I told them that I want to finish my basement by Spt 7th as we are planing to hold my daughters Birthday party. Cavanna Construction said that that is little aggresive but we will see what we can do and I knew that the Spt 7th is little aggresive so I asked them if they can finish the basement by Spt 17th. This was accepatable to them and they agreed ( First promise).

Now back to the payment of $16000, they took the money and left. Two days later the check was cleared from my bank account. According to the Cavanna Construction, every single penny of the $16000 was to spent on the materials. I will get back to this at the end of the story. So couple of weeks passes by after the first payment of $16000 and I never heard back from Cavanna Construction about the progress.

I called Cavanna Construction and talk to Racci Cavanna about the concern as it was end of the Aug and we needed to sent the invetation to friends and family about by daughter's Birthday party which we were planing to hold in my FINISH basement and I knew that Cavanna Construction may not be able to finish by Spt 17th. I raise this concern and asked Racci Cavanna if they can finish my basement by Oct 20th. This time Racci Cavanna was so sure and confident that Cavanna Construction will be able to finish the basement by Oct 20th. (Second Promise).

So accordingly, we sent out invitation to our friends and familiy about the B'Day party on Oct 20th. Now the lies from Cavanna Construction starts. Couple of weeks passes by and as before, I never hear from Cavanna Construction. I called her and left voice message regarding the status of the project and were do we stand. Cavanna Construction called me back saying they have ordered the materials and since I wanted to have custom columns in my theater, it took little longer but she has got the confirmation from the Vendor from which she orders materials from and columns that it should be here by next week and as soon as the materials are here the next day WORK WILL START. Racci Cavanna also gave me another reason of little delay was due to the miscarriage she had and she was going through little depression. Now is that my problem? Ofcouse not. Did i tried to work with her on this situation. Yes I did.

Anyway, I reconfirm about the Oct 20th and again she assured me that the basement will be finish by Oct 20th. This was in the second week of Spt 07. Again couple of weeks passes by and as usuall, I never hear back from Cavanna. This time I got little frustrated due to the lack of communication from Cavanaa Construction. I tried to call them and Cavanna Construction never got back to me. As a result, I decided to call TheaterXtream. TheaterXtream called the Cavanna Construction and informed me about the custom materials not being present and the personal problem Cavanna Construction were having. I again compromise and worked with them and got assurance that basement will finish by Oct 20th. Now I knew that something is going on and my basement will NOT BE DONE by OCT 20th.

Week later, now we are in the first week of Oct and have only couple of weeks to finish the basement by Oct 20th. Again, I never hear from Cavanna Construction and tried to call them. Cavanna Construction never got back to me and as a result, I called the TheaterXtream to find out what is going on as I was really frustrated knowing that my basement is not going to finsih by Oct 20th and we had scheduled B'Day party on that day. I asked TheaterXtream to inform them that if they do not start the work in week, I DO NOT WANT THEM TO FINISH MY BASEMENT. Instasntly, I received call from Cavanna Construction saying that custome column is taking little longer then expected but as soon as columns gets here, the next day they will start the work and promised to work long hours and weekends to finish the basement.

At this point, I was aking question to myself that the use of custom columns will be in much later weeks but if they want they can start the work and start the framing the basement, electricals, drywall..etc and by the time that work is done, the columns will arrive then WHY CAVANNA CONSTRUCTION IS NOT STARTING THE WORK? But this question stays with me. Anyway, now we are in the second week of the Oct and I am positive that my basement is not going to finish by Oct 20th. CAVANNA MISSED THEIR PROMISE. I was constntly living in fear of loosing my money. Phase II: Work Starts and commitment shown by Cavanna Construction to finish my basement.

First Week: Now we are at the last week of Oct and the promised date to deliver my finish basement on Oct 20th is missed by Cavanna Construction. At the end of third week, I called Cavanna Construction and told them that if they don't start the work by next week then I do not want them to finish my basement and expect the refund. Racci Cavanna said that Cavanna Construction workes will be their by 8:00 AM on Oct 29th Monday. At this point I have waited little over 10 weeks for them to start the work. Work starts on Monday Oct 29th around 9:30 AM. Now I was little relived seeing the work has atleast started and Cavanna Construction will do everything to finish my basement as soon as possible as they promised to work long hours and weekends to finish the basement.

Out of curiosity, I asked Vinny Cavanna about the estimate on how long will it take to finish the job? (This is what Cavanna has said in their responce that I kept asking Vinny how long will it take him to finish the basement). Well, it is my job to ask them this question. Anyway, Vinny said that it will take 4 weeks to finish the basement. So I was expecting to have my basement finish by forth week of Nov.

Moving to the story, on Oct 29th, Cavanna Construction did some framing and left around 3:30 PM(Including 1:30 hour lunch). So they workd only about 5 hours on first day. I was little suprise when they did not put full 8 hours of work. Anyway, moving to next day, Cavanna Construction came around 8:00 AM in the morning and worked were not able to get into basement becasue it was locked. So rather then calling me to open the basement door, they decided to take a day off and took off and never came back. When I called Racci Cavanna around 10:00 AM, she said that they were there but could not get into the basement but they should be there very soon. (Again Lie). They never showed up. Again I was suprise and left thought how can they just leave and now show up knowing that they are running 5 1/2 weeks behind the schedule. Atleast they should have called me to inform that Cavanna will not be working today out of curtosey.

Anyway, next day, when Vinny came to work on my basement, I asked him "What happend yesterday?" he replied saying "well, I am working on another project as well. So I work on your basement in the morning and work on another project in the evening". Did I have any objection to it? NO. Did I work with Cavanna on their busy schedule? Yes. The reason to these question is again Cavanna Construction's promised missed delivery date and how it could have impecated my project. But I worked with them on this. So till end of the week, they work only 5 hours a day and they Finish most of the framing. Now I know that Cavanna leaves the work site around 3:30, before they leave, according to the contract I was to make first payment in the amount of $3910 so I went down in my basement with the check of $3910. As per contract I made my first payment.

When they left the work site, I asked them couple of question weather they will be able to install franch door in my walk out basement door and in my kitchen. Vinny said that since the framing is done and next thing is electrical, his electician will not be on work site till Tuesday next week, he has a day to work on the doors and it should not take him more then a day to install the franch doors. So I said, ok I will go ahead and buy the doors from lowes and when he comes in monday morning, he can pick up the doors from Lowes. We agreed and week ended.

Second Week: Next monday morning, Cavanna Construction did not showed up for work and later on I found out that they did go to the Lowes to pick up the doors but Lowes did not release the Franch doors. Cavanna tried to call me but were not able to get hold on me so they left voice message. I got back to them and said that I can go with them to pick up the doors, they said "No problem" but they never showed up on Monday. So far they have put only 20 hours of work in my basement.

Next day which is Tuesday, Cavanna construction picked up the doors and in about four hours they installed the doors in my basement and in kitchen. Did they finish the installation? No, they did not sealed the kitchen door with the trims and said, trim does not fit so we will have to get the another trim to put around the door. I went to Lowes and got the trim according the measurement. I asked him about the electrician and they said he should be here soon but their electirican never showed up.

Next morning on Wed, workers from Cavanna Construction shows up around 9:30 AM with the electrician and discussed location of the outlets and lights and started the work. They worked for couple of hours and left and never came back. Again I was suprise and little frustrated with the lack of commitment to work to finish my basement from Cavanna Construction. Thrusday and friday, only electrician came to work around 1:00 PM and he worked four 6 to 7 hours to installed the electricals. I asked him why you are the only person working and not vinny helping you out. His reply was "Vinny is working on other job site". Vinny never shows up on this Friday to collect the second payment of $3910 and since the electrician was only worker and I did not had written request to release payment to electrician, I did not give him check. (This is what Cavanna Construction is complaining about delaying in second payment). Cavanna Construction again worked only about 20 hours as a resulet I was not happy with the way things were going due to lack of commitment from Cavanna Construction. They should have given very high priority to finish my basement knowing they are running 5 1/2 weeks behind but the commitment was missing and I decided to run this concern with them on Monday morning.

Third Week: This is the begning of third week and so far they only have framing and electrical done that too not 100% done. We are now in third weeks monday morning. It was around 10:00 AM and Cavanna Construction did not showed up so I called her to find out what is going on. I was informed by Racci Cavanna that Vinny and his worked has gone to Lowes to pick up dry walls and other materials. WOW!!!what a suprise, I was told in the begning that every single dollar of my $16000 has gone on materials and they have warehouse to store the materials then why Vinny went to pick up materials from Lowes? (This is proof of thier another lie). Anyway, she said that they will be there by 11:30 AM with the dry wall and other related materials. Just a side note, (SO FAR THEY HAVE SPENT ONLY ABOUT NOT EVEN $2000 ON THE MATERIALS.).

Cavanna Construction comes to the job site with dry wall materials along with Racci Cavanna. She asked me for the second payment which I had no problem and handed the another check in the amound of #3910. I also paid them $360 for the doors. I raised the concerns I had about the lack of commitment and she assured me that my basement will be done. After collecting the check, they left and never showed up for the rest of the day. Now it was getting really frustrated specially raising my concern which they completely ignored. So far I have paid them about $24000 out of total of $31640 which is about 80%. So is my basement finished 80%? Not even 25%. I am not trying to say that I paid 80% so my basement should also be complete 80% but atleast close to 80% and some commitment from Cavanna Construction to finish my basement.

Anyway, in the evening of Monday, their electrician shows up around 5:30 PM and starts installing dry wall. That was suprise, electrician installing dry wall. I went down asking him why they left in the morning and never came back? He said that Vinny had to work on other project and he also asked me to work on other project and not mine. Again I could not do anything but getting frustrated. I am asking question to my self "Am I not paying him Dollar bills?" The answer to the question is "I AM PAYINIG HIM GREEN DOLLAR BILLS" then they they are not paying full attention to finish my basement and lacking commintment. But I could not do anyting but to get frustrated.

Any the end of the Monday of third week, the electrician spent about 3 hours to install dry wall on only one wall which is around 13 feet. So based on this, I started calculating how long will it take him to finish installing dry wall in the full basement and came to conclusion that it will take him another week and half just to install the dry wall for single person and they still have spackling, sending, painting, trim install, 3 doors, carpet installation to do and I realized that it will take them at least another four weeks to finish my basement if they send the crew of two worker and I had only two more payments to made in the amound of $3910.

As a result, I decided to help his electrician to install the insullation and dry wall. I know that Cavanna construction should not care about it but I wanted to get my basement as soon as possible. I helped electrician to install insullation and dry wall which by the way I used my own tools to do that. I never used their tool as they claim and I too have witness to prove that. So at the end of the third week with my help, most of the dry wall was installed in my basement.

At this point, the level of my frustration was at its peak and I could not bear it any more. So politly I asked Cavanna Construction to show some curtosey and accept the rest of the payment at the end of finish product. This is where it all started. Cavanna Construction refuse to accept that and reminded me that I am bound by contract to make payment every week and it is very imported for me if I wanted to continue the project. So far I been very petience for my basement to finish. I worked with Cavanna Construction on every one of their situation personal or business and waited this long after giving them all they asked for and they do not want to wait couple of more weeks as they claimed it would take them couple of more weeks to finish the job which I knew that is it not true. I sayed firm on said I will pay them rest of the balance when they finish the job. They theretened me to abendanden the work. I said it is their choice. If they want to work, they can but I will pay remaining balance at the end of the project completion as I DO NOT TRUSTED THEM ANY LONGER DUE TO ALL THE LIES AND LACK OF COMMITMENT THEY HAVE SHOWN ON MY PROJECT.

Cavanna Construction has claimed that I theretened them and told them they can not pick up their tool. Well, again I have proof to prove that that too is lie. In have specificalled mentioned in my email that they are most welcome to pick up their tool if they decide to abendan the work and that exactly what has happend. Cavanna Construction has taken so far $24000 of my money and my basement was not even half done. Now Cavanna Construction said that make us the third payment of $3910 and this matter will be resolved.

Well, here the suggestion, as per Cavanna Construction, every single dollar of my first payment of $16000 has spent on materials. So far they have used materials worth of only $2000 so out of $16000, they can substract $2000 for materials and $3910 for the third payment. Remaning balance of 10090 should be refunded back to me. Also based on the contract, if they consider the third payment from the $16000, then have to finish my basement which they are not going to be able to do so as I have started working on my basement on my own and after they left, lots of work has been done. In one instance of the discussion of this matter, Cavanna Construction brought this to my attention that THEY DO NOT HAVE MANY EMPLOYEES. ONLY ONE FULL TIME EMPLOYEE WHICH IS WHY THEY ARE RUNNING INTO THESE TYPE OF ISSUE. Is that my problem they do not have enough employee? No.

All I care is they were suppose to fullfill their promise and deliver what they said they will deliver which they failed to do so and not only in once, number of time they failed. Cavanna Construction made me to take this action. I never had problem paying them as I have paid them and I would not if they have shown the full commitment to finish my basement and worked full 8 hours atleast every week with the crew. That would have shown commitment level they are putting on to finish their work but that was not there. They did what ever they wanted. They wanted me to obey the contract but they did not wanted to do. We both have signed the contract, not just me.

In the responce to BBB, Cavanna Construction claims that they are on top of the Schedule to finish the basement. My question to them is what schedule they are talking about? Have they discussed that schedule with me? If they are talking about schedule of Oct 20th, then I just wanted to again remind them that they are way behind that schedule and if they are referring to another schedule then, I am not aware of that schedule. May be their schedule was to finish my basement in next six months but I do not want to wait that long. This again show the lack of communication from Cavanna Construction. In the responce to BBB, Cavanna Construction claims that I did not have sufficiant fund to pay them. Well, guess what! again lie.

After the issue raised of the third payment, I provided number of options to Cavanna Construction to move forward with the project completion and every one of them was denied by Cavanna Construction. They kept on saying I have signed the contract to make weekly payment. Well yes I did but they also signed the contract to finish my basement. Was that fullfilled? NOOOO. One of the option I gave them was I will make third payment (They asked for the personal check and last check certified check), I responded saying I WILL GIVE THEM BOTH THIRD PAYMENT AND LAST PAYMENT as certified check but when they come back to work, they have to bring all of my materials and they can use my garage to store that materials and on very same day when I responded with this option, I went to my bank and got two certified check payable to Cavanna Construction. I have copies of that check to prove. So when they said "I DO NOT HAVE FUNDS TO PAY THEM", that is lie. Anyway, they came to collect the check but without my materials. So I suggested, they can continue work but I will not make third payment until they bring all of the remaining materials to finish the job or untill they finish the job but they decided to abendanen the work and took their tools.

Again, I have signed copy of letter from Vinny saying they have picked up the tools and will return the materials that requires to finish the job in a week or refund the money in the amound of $10000. I will also attach copies of every payement I have made to them and the copy of the letter to prove what I have said here. Also, here is another major point, according to the township code, when you are doing fraiming, you are suppose to install the fire stopper at the distance of every 10 feet. Cavanna Construction has not done that.

In addition to that, the fraiming is not in the straight line. This shows the quality of work they did. Based on this, anyone can judge who is on right side and who is on wrong and why I made a decision to pay Cavanna remaining balance at the end of the completion of project.

I would never hire another contractor to do the job in my house. I can't even belive how can someone take money that does not belongs to them and relex. Please guys, do not give out your money to the company like Cavanna Construction. You work very hard for it. I made a mistake by trusting Cavanna Construction. Hope you don't do the same.
