Probate is a rip off, hiring lawyers to bill the estate tens of thousands of dollars for performing simple secretarial tasks like bill paying. Any competent and conscious family member can perform these duties. Unfortunately for the grief stricken widow and her family, even bill paying can be daunting...at first.

 

However, a new type of rip off that is rearing its ugly face in probate is the commercial lease scam whereby the landlord obtains a personal guaranty from the tenant. This is just the case in El PasoCounty (Colorado Springs, Colorado) where a landlord under the guise of an "asset management" company filed an excessive and outrageous claim against a recent widow's estate for $299,423.79 claiming rent owed for six months.

 

Notably, the former Personal Representative of the Estate was a lawyer who failed to communicate with the beneficiary of the estate that resulted in late fees and penalties! Just the type of help you don't need from a lawyer.

 

Included in these court documents was a bunch of mishmash and "acreative accounting methods" similar to those used by seedy lawyers to drain assets and cost the estates hundreds of thousands of dollars.
