My Husband and I had a loan with Centex, the interest rate was to high, so we signed with Ameriquest, w closed on May 17 or the 20th, sent papers to Centex, they went in our checking account on June 5th, to take a payment, we were with the understanding that they had been paid off,

a rep called me and asked waht they could do to keep us as customers, I explained that the interest was too high and we needed and fixed rate, we couldn't afford to pay them, my husband is disable,but they are still calling bothering us and threathing to foreclose on our property, we've done three calls, trying to resolve the matter, just minutes after getting of the call another rep from Centex calls to collect a payment,

we want our overdraft payments back, plus they should pay for harrassing us and threathing us, they are very rude, they not listen, they try to make us feel dumb and stupid, we never received a copy of the appraisal report, after being told that we would get it, this has gone on since May, we've had numerous calls from a Pam Williams in collection, theres no talking to to her,

after spaking with her my husband got sick and had to go to bed, they will proabaly call today and will try to get the money out off our account on the first of the month, what should we do to stop this unprofessional, illegal behaviour, we need help fast, we can't take this anymore, can we take any legal action against the company and the rep?

Sorry to hear of your bad experiences with Centex. I too am a victim of Centex's practices. Reading your report only reinforces my thoughts about them as being a predatory lender/servicer. They prey on people like you, me and others who are in difficult situations and who need to hang onto our homes. The first thing you should do is contact you state's Attorney General's office, the consumer division and file a complaint against Centex.

You should also contact the Federal Trade Commission who does not investigate, but are keeping track of complaints like yours. The next thing you should visit the HUD.gov website and go to the RESPA section (Real Estate Settlement Procedures Act) and find the example of a Qualified Written Request for you to send to Centex obtaining a copy of all you loan files. Not knowing your whole situation, don't know if this was a first or second mortgage, it's hard to state much more. But, if it was a first mortgage and you refinanced with the other lender, then the second lender screwed up in paying off Centex. Anyway, you need to file a complaint.
