We had our mortgage with Chase Manhattan mortgage company then in November of 2003 Chase sold our mortgage to America's Servicing Company and we were sent a letter telling us to send all mortgage payments to them starting in December 2003.

January of 2002 Chase attempted to foreclose on our house stating that we were behind on our mortgage payments. Chase stated we had 15 days to show proof of our mortgage payments that were not even being made to them. Or they would take us to court. We had to go to our bank and pay to get copies of cancelled motgage payment checks and our lawyer sent a copy of the letter that we had received from Chase stating they "chase" sold our mortgage to America's Servicing Company.I received a letter from my lawyer stating that Chase had dropped the case upon receiving the cancelled checks they asked for.

I was then told that I would never hear from Chase again but it is now August 19,2004 and once again Chase is trying to foreclose on my house and once again they want proof from my bank that I have been paying my mortgage which they no longer own.I want to go after them but my lawyer says just send them the cancelled checks and be done with it but I don't think this will ever stop!!!!!

Suggestion for your attorney

In my dealings with CMMC' attorney, I have been told that they "sold" the loan I have referred to above. They said they sold it to Citibank, N.A. Later, after investigating, Citibank N.A. or any of Citibanks holding banks or affiliates deny they even have the loan.

CMMC now claims it was on paper only- and yet later claim it was part of a pooling agreement in another state. My suggestion is to inform your lawyer of this information (I don't know how legal selling something on paper is, but according to what I have found out- it could be that "someone" within CMMC has been committing fraud on loans
Just a suggestion, but whatever you do, make sure you have documents to back up what you are saying.
