Cherry Hill Triplex They screwed me and sued me -dealership not honoring my warranty Cherry Hill New Jersey
Hello everyone,
I made a posting about this dealership not honoring my warranty back in 2004. Here's an update for those of you considering giving Cherry Hill Triplex your business.
The dealership is SUING ME because I purchased metallic signs that said "cherryhilldodgesucks@yahoo.com" and "caution: don't buy Chrysler or Cherry Hill Dodge" and placed them on my vehicle!
They are suing me for tortious interference in a business! I assume they want to pursue damages for any loss of business from the signs and enjoin me from being able to put the signs on my vehicles.
What ever happened to my 1st Amendment Right to free speech????
I am not an attorney but am representing MYSELF against a rather large law firm the dealership has retained, Capehart and Scatchard. This case that is due to go in front of a jury in April of this year.
They offered me a settlement that was basically a "gag order" in which I would agree not to say ANYTHING negative about the business. I did NOT sign this and am fighting for my right to speak out as a disgruntled consumer. I am fighting for you...for us....the stepped-on, poorly treated customer!
Do you want to patronize a company that will sue a customer because he publically displayed his unhappiness with the dealership?
I caution everyone to think not twice..but three times before walking into that dealerhip!
One day while I was in court, there was another case in the court between Cherry Hill Triplex and a group of people suing this dealership for their advertising. In addition, I was contacted by another women who filed a complaint with the NJ Attorney General and said she has an arbitration hearing next week. What does this say about a business? Read all the complaints on complaints.com about this dealership. There are over 30 printable pages!

Hi Jim,
You have a very interesting case...please keep us updated as to how it turns out, as I have had occasion to do the exact same thing.
We have broad 1st amendment rights in the USA, but businesses are protected against defamatory comments that would "injure" their doing business. Where the statements you made on your car fall, I do not know as I am not a lawyer. What I do know is that your comments were a bit vague so the dealership will have a difficult time in proving that your statements were made with malice.
I do hope you are successful, as you appear to have been "screwed" by the dealership in regards to the warranty on your car. To be successful, I think the dealership will first have to prove to the jury that they did in fact honor the warranty and therefore your position as a disgruntled customer are baseless.

Just a suggestion in regards to this type of consumer action for others - it is always best to phrase any statement as one of opinion. For example, you could find yourself in hot water if you wrote "(dealership) treats their customers like dirt." It is much safer to say "In my opinion, I was treated like dirt at (dealership"....people will get the idea.
Always make statements that are clearly one of opinion and steer clear of sweeping allegations that you have no basis for. It's never wise to say "(Dealership) does not honor the warranties it sells" because you have no basis to make such a claim. Keep it to personal experience and that of a clearly stated opinion.
Again, good luck with your fight, Jim, and keep us posted as to the results! I think we can all learn about libel/slander law and how to effectively use it.

Speak out we have the right to freedom of speach & report bad dealerships bad businesses bad employers ect... If you are new to this sight let me warn you people will try to tear you apart make fun of you & say horrible things in support of the company you report, or be rude to you! don't give in to rude abusvie ignorant people who don't want you to speak out car dealerships, & bad businesses do not like it if you say negative things about them they will think you are defamanted them because they have the power to say it, then they want to file suit agaisnt you in court for defamantion & slander! if you say any bad things you will see it all over this website. Just fight back @ your accusers who say you are a liar & are lying about the bad business & the dealership who accused you of defamantion they are alot of people who will accuse you of being a lair & that you are defamanting them!, just continue to speak out & fight the ignorant accusers who accuse you of lying you will see it all over this website of ignorant people of accusing people of being liars inculding myself.
