Complaint Review: children services

            This letter is in response to the outrageous and ludicrous complaints filed by Childrens Services against my family and me.  I, Joel Moyer, am a Christian and try to live a Christian life to the best of my abilities. I work full time to provide for my family and I try to raise and teach my kids the best way I know how.  I do not smoke, drink alcohol, do drugs, nor curse. We attend church on a regular basis. I served in the Army Reserves and received and Honorable Discharge. As such I do not claim to be perfect by any means. This complaint tries to portray a situation that is not true in any way, shape, or form.  I will provide a response for each complaint.

            First of all, Sarah, my daughter, was born a normal healthy child. This all changed at approximately two months of age. One evening after I got off work, I took her to the pediatrician for her routine exam where she received the standard vaccines.  Through the night she had developed a severe allergic reaction to one of the vaccines.  During the early morning hours of the following day, as I was preparing for work, I heard my daughter crying and struggling to breath.  I rushed her to the ER where she progressively got worse and even had a cardiac arrest. She remained critical for many days. This was all caused by the vaccines administered by her pediatrician (which is well documented and proven).   On Sarahs behalf, I have sought litigation and was awarded damages for Sarahs future care through the National Vaccine Compensation Program.  These services are in the process of being utilized.  I also want to point out that on a follow-up appointment, (after her discharge from the hospital), her pediatrician once again gave her another vaccine and again she experienced additional spasms and seizures.  These were vaccines that are recommended by the state and by the school system.  Now my daughters life is ruined (unless God intervenes).  She can never have a normal life because of this careless pediatrician and the requirements of the state.  They should test to see if there will be any type of allergic reaction, especially after the first series of vaccines stopped her heart and caused convulsions. I am very protective of all my children and very skeptical of anyone and everyone they come in contact with. After all this, wouldnt you be?  Whereas, this is not a part of the complaint, I feel this is very important information that all parties concerned be aware of.

Sarah is capable of eating soft or pureed foods.  We as a rule do not allow the children to feed Sarah. Nor do I allow the children to carry her.  As most children do, they mimic what they see. They try to help when they can and have a mind of their own. We provide 24-hour care for our children but it is impossible to monitor every action of every second of every day. Kids will fight; they will play rough and will have accidents. If this is neglect then every parent of every kid should be here.  We do lay Sarah on a blanket on the floor to exercise her muscles and to allow her to roll and turn and to encourage her to learn to crawl.  This is much safer than doing this on a bed or a couch. We routinely do stretching and leg and arm rotations. We often place her in a chair for play-time and many other activities.  We also hold her and play with her during the day.  She routinely receives PT, OT, and speech therapy at North Western special needs preschool. She goes four hours a day three days a week.  Next school year she will go five days a week. Previously she received these at Dayton Childrens MedicalCenter prior to beginning the school program.  We follow all recommendations from her therapists and pediatrician. We have her on the waiting list at Childrens MedicalCenter to receive additional therapies.  We believe therapy is very important for Sarah and it does not end at school or a classroom. It has to be done at home as well.  We do actively participate in her care and even my other children participate, whether it is through modeling or just playing with her.  It is easy for many people to sit back and criticize us but do not have to live up to the same expectations they expect from someone with a special needs child.  We do love Sarah and know with a child like this that it requires extra love and care that many healthy children never receive.

Hannah does have tantrums.  We feel she does this for attention and when she does not get her way. We choose not to acknowledge her when she does this.  We reward her for good behavior and punish her for bad behavior by sending her to bed early or not allowing her to play with selected toys. When she sees that the tantrum does not get her way, she stops and goes about her business.  Tantrums are normal and common among many kids. This again is not a sign of abuse or neglect. I would like to point out that these tantrums started with Hannah after spending many weeks in the hospital with us caring for Sarah. FCSCC had us under a microscope then, just like it is today, and felt that we were unable to correct her.  Both the reason for being in the hospital and Hannahs tantrums we feel are due to the states intervention.  You will notice my other children do not have tantrums.  Hannah does not have scarring from self-inflicted wounds. As you can see from their pediatricians letter and from my own scarring that my children and I all have eczema.

FCSCC and CASA have complained that I am uncooperative.  I have been acting under the advice of my attorneys. I was advised not to speak to these agencies unless my attorneys are present or told otherwise. FCSCC and CASA have been informed of this, and yet continue to contact my wife and my children.  They have conducted interviews with my children while they were attending school.  This was embarrassing to my kids, as well as mentally and psychologically scarring to them.  All this was done without parental consent.  I have attended several of their counseling sessions in the past and again in Dec 2009, only to be attacked about my religious beliefs, which is still against the First Constitutional Amendment. 

         Children Services has made many false and slanderous complaints against my family and me.  Rachel and I have had our marital issues in the past as most Americans do. Many of these accusations were lies made by her to cover up her infidelity, to put herself in a better position to have custody of the children, and by the prompting of FCSCC. On many, many occasions FCSCC has made slanderous accusations that I am controlling my wife and family through a, and I quote a Christian cult.  They claim that I tell her how she must dress and wear her hair.  They have told my wife that she does not have to put up with this and that she needs to let her hair down and get out of the house for a while.  Rachel has always been soft spoken and very shy, so what they propose is totally unacceptable. This is exactly how she was and how she dressed when we met years ago at a church camp. She doesnt live a Christian life for me, she lives it for God alone, or it would be of no value. We have sought marriage counseling and feel we have since resolved many of these problems.  Rachel and I do face more stress than most people when it comes to raising children.  This is not something most people can understand unless they have a special needs child.  I have never hit my wife nor abused her or my family in anyway.  I have slapped her on the rear with my hand in a playful, loving manner. She told me that she does not like this and I have stopped.  This is one of the issues we have worked out through counseling. I do not prevent her from taking medications or receiving additional counseling.  In fact she has tried this and did not like it.  She felt the medications made her tired all the time and even sick at times.  She stopped these on her own and it was her choice.  Please understand my wife is an adult and I support her making her own decisions. I have even arranged for her to have transportation for therapy in the past while I was working. I believe in eating healthy and taking vitamins and even herbs.  I have suggested to her to start eating healthier and to take vitamins.  Since when is this a crime?

 The agency has also implied that I prevent my family from seeking any type of conventional medicine.  This is obviously not true.  My daughter, Sarah, is in this type of condition due to vaccines, which all my children received.  She has received and continues to receive conventional care as the medical records prove.  Understandably, my faith in conventional treatments has been shaken.  However, as I mentioned, I continue to seek conventional care for all my family as needed.  I do feel it is my right to seek help with alternative medicine as well for the benefit of my family.  The agency feels it has a right to tell us we cannot and will not pursue this even though they havent any legal basis.  I want to be very clear about this; I do not want this non-medical agency dictating the type of medical care my children should receive.  I want a qualified, licensed pediatrician of my choosing to see to my childrens medical needs.

The concern about my choice of punishment is about my choice of spanking my children.  Yes, on occasion, I have spanked my children.  I feel that the fear of a spanking is a strong deterrent and does not need to be utilized very often. This is a very strong belief among many Christians in the world today.  If this is a crime then billions of people would be in jail today.  At the last mediation the county prosecutor laughed at this complaint and stated and I quote, Spanking is not illegal and in fact the State encourages this form of discipline.  I have never left bruises on my children or excessively spanked them.  I am always very careful with my children, especially my girls.  My wife does not like to spank, however, the children do mind me better. Spanking as a discipline is often upsetting to her. This is an issue that we have discussed, and I feel we can resolve on our own.

I feel that FCSCC has harmed my children.  Childrens Services has, without my permission, stripped searched my children looking for bruises and havent found any.  This was against my beliefs and has been very traumatic to my children. In 2006, FCSCC stormed into my home without warning.  I wasnt shown a warrant.  I tried, but was not able to reach my attorney, so I didnt know my rights and had no representation. They told me that they will take my kids out of my house and they will be strip searched by strangers for signs of abuse, which none were found. They said that since my wife was currently in the hospital and I had not been properly trained on Sarahs nebulizer, which they also felt was missing a part, they felt that Sarahs life was in jeopardy. So they not only took Sarah, but all four of my children, who were traumatized by a strip search, and placed in a foster home where they cried overnight.  They also said that they couldnt find any available relatives (I have five brothers, my parents, and countless other relatives in this area)!   The next day, my brother, who is a licensed, practicing respiratory therapist and his wife, an RN, picked up my children only to find out that they didnt know anything about Sarahs breathing machine or her medications that went with it!  It was also ascertained that these were for breathing treatments that were not needed. Sarah did not and does not have asthma! She had tracheal malacia, which albuterol is not indicated for and will not help.  This is well documented and proven. A point no one seems to care about.  They did not take any of Sarahs medications nor did they take her albuterol. Is that not hypocritical?   They took the children and had them examined by a pediatrician and again found nothing wrong with them. All this was done and no evidence of any kind of abuse or neglect on our part was ever found or will be found.  Why then would anyone in their right mind want to go through that again? My kids are all clean, well fed, and above all loved.  We love our children and care for them far better than any county employee or foster parent.  The agencys record is far from tarnished when it comes to choosing foster parents. FCSCC has a proven record of abuse and neglect towards children under their care. Besides the above mentioned mental and physical abuse forced upon my children then, and on numerous other occasions, they refuse to protect other children from a fate similar my daughter, Sarahs. The children are like puppy mills to them. They continue to attack the victims instead of the perpetrator of the malpractice.  FCSCCs neglect and abuse recently caused an untimely death of a young child that was duct taped and placed into a closet over a weekend.  Yes, FCSCC caused this death because this child was under their responsibility and care.  They cannot even care for the children currently under their care and they criticize us. They refuse to help children who are being sickened and killed by 2^nd hand smoke from their parents.  Yes, 2^nd hand smoking kills, which is the reason for a ban on smoking in public places.  In the U.S. alone, approximately 38,000 people die each year due to 2^nd hand smoke and up to 300,000 new cases of babies under 18 months develop bronchitis and pneumonia.  60% of U.S. children ages 3-11 are exposed to this yet, this agency writes a four-page report on how my daughter has a nose bleed and how the other one has a temper tantrum!  And they want us to go in for a psyche evaluation! I wonder how many of these case workers are sickening and killing their own children with 2^nd hand smoke without any type of investigation.  I feel that this particular case worker needs to be removed from her job until she undergoes a complete psyche evaluation. She is taking her job to an extreme.  Their slanderous four page reports have cost and continues to cost my family thousands upon thousands of dollars in legal fees.  Much needed funds that could be better spent elsewhere. I feel sorry for families that are not able to afford such an onslaught.
