Dear Mr. Nardelli:

First of all, I would like to introduce myself. My name is Brian. I have been dealing with Chrysler Financial for many years. I have bought several vehicles from your facility in Mechanicsville Virginia, Mechanicsville Dodge.

In 2005 I purchased a 2005 Dodge Ram 3500 Diesel Truck from Mechanicsville Dodge putting a down payment of $35,000.00 on said vehicle. This was my dream truck. The trucks sticker price was over $47,900.00 of which I purchased the extended warranty and my payments were only $210.00 per month.

The payments were to start in July of 2005 of which I have never missed a payment! I filed Chapter 13 {reconciliation of debt} Bankruptcy in 2006. Because of filing this bankruptcy I had to include all debt that I owed. It was never my intention to have Chrysler Financials debt dismissed or entered into. I continued to make my payments on time every month as scheduled.

At the beginning of summer of 2007 I was informed by my attorney that Chrysler Financial said I was 3 months behind and I needed to show proof of payment, which I did. This went on and on to the point of Chryslers Attorneys insisting that I give copies of my entire checking account statements as well as copies of checks front and back; which I will gladly supply to you upon request.

Well I complied with their request. I gave as many of the checks as I could that were written, but most of the payments were directly debited out of my checking account directly from Chrysler and listed as a Chrysler Financial Payment. I gave an 18 month complete history report to them. This was still unacceptable!

This is such an outrage! At this point in the story, Chrysler wanted to repossess my truck because they claim they were missing payments.

I am a simple blue collar worker. I work very hard at Home Depot and have been for the past 8 years. This was my only transportation. With having a home and family to support, I was forced to sell the vehicle to Mechanicsville Dodge when I owed only $7,700.00 on the truck. With having only 1 vehicle now for my wife and I to share working different jobs and schedules makes it very difficult.

I lost over $40,000.00 of equity in my nearly paid off truck, because I was forced into trading it in instead of having it taken from me. In looking over the cancelled checks, Chrysler Financial would take sometimes as long as 49 days to process my payments. My payments were mailed out in a timely fashion. Even after I sold the vehicle on August 31, 2007, we had a tow truck come here on September 19, 2007 to repossess the truck.

I would like to propose, you to use your capabilities as CEO to help me in this situation and to either get my vehicle back at no cost or to replace it to one identical of the one I had and also to correct my loan history.

Screwed twice by big bob nardelli? First at home depot and then at chrysler? He's suppose to have left HD with like $40 to $50 millon and now he's running chrysler. What a coincidence. All I can say is "..putting a downpayment of $35,000 on a $47,900 truck". And then declaring bankruptcy within a year. Wow! I wonder why. I go after the attorney for not doing his job.

Your lawyer (assuming bankruptcy lawyer) really dropped the ball. If you included your debt with Chrysler financial in your bankruptcy papers, they have absolutely no way of being able to reposess your truck. They shouldn't be collecting any money, nor should you be making payments while your debts are being reconciled by the bankruptcy court.

Why would you write a letter to Bob Nardelli, the Ex-CEO who was ousted from Home Depot months ago? Why would you expect him to do anything for YOU?
And I agree: why isn't your attorney writing letters?

It sounds like your attorney fell down on the job. He/she should have been advising you and contacting Chrysler financial instead of you.

Interesting notes in your post :
- you are a simple blue collar worker who goes out and buys a $35,000 truck
- you don't really get equity in a truck like you do a house, you may have paid over $40,000 but that is not equity, it is just poor financial planning
- you must have had a whopping down payment for you payment to only be $210/month
- you've gone through bankruptcy a year after you bought your truck

I'm sure you realize you have to get your finances in order and live within your means.

That shows where your priorities are. You had a hard time paying your other debts, so you then buy a $50.000 pickup truck. Now you gripe because the lender is basically nervous about you. Gee I can't imagine why. My question is? How is this a ripoff?

Where was your lawyer during all this?

This doesn't make sense to me. Your report claims you had a lawyer and that you had PROOF that all payments were made, and yet you had to sell the truck back?

Bank records are bank records are bank records. If the payments were made as you claim, it seems to me that it would have been a simple matter for your attorney to approach the court and request the court direct the finance company to cease all reposession efforts until the matter could be properly cleared up.

Further, it seems to me that your attorney should be sending letters to the finance company rather than you.

Why isn't your attorney doing these things?
