My husband bought me a TomTom 920T for christmas. There was no mention to him when he purchased the product that if it was opened he would be charged a 15% restocking fee $100. If this had been the case he would never have purchased it.

We opened the TomTom got it working with the exception of the voice recognition area, no matter how hard we tried it would not recognise my voice, since the whole reason for buying this model was because you could talk to it and be hand free while driving the product was of no use to me.

We took the product back within a few days of buying it only to be told we had to pay a restocking fee, or we could buy something for the same value if we wished otherwise pay the $100.00.

As there was nothing else I wanted to purchase I had no choice but to pay the $100.00.

I felt this was unfair and called the 1800 number only to be put through to a person in another country who would only quote the policy.

I will never again shop in Circuit city and will make sure I tell everyone about their unfair practices.

This not an unfair practice, it is a common practice, and is getting more and more common.

Best Buy, Circuit City, and now even Wal-Mart have restocking fee's on certain items! The fact is, on his receipt it states that full policy on it, it was his choice not to read the return policy before opening the product.

Circuit City did not make the product, they just sell it. Chances are high that it was not defective, that model just may suck at voice recognition etc...

Once that item is open, circuit city can NOT sell it as new! Period! They generally knock 15% or so off of the price and sell it as an open box item.

So if a bunch of people bought GPS's, Cameras, Camcorders, TV's, Computers and returned them just because they do not like it, or do not want it, circuit city would loose TONS of money!

Digital cameras, camcorders, desktop PCs, notebook PCs, monitors, printers, scanners, projectors, PDAs, mobile video, *GPS* and radar detectors must be returned within 14 days of the sale date, and (except where prohibited by law) are subject to a 15% restocking fee if returned opened or in a non-factory sealed box.

The policy is on the back of the receipt, on www.circuitcity.com, and on signs at the store....so that should eliminate having you tall everyone about this "unfair practices" since it is openly publised to the public.
