The complaint concerns problems that I have experienced with my new television, purchased on line, which has subsequently stopped working after 34 days of ownership.

I purchased a 50 inch Samsung DLP television (HW-P5063W) on December 4, 2004 which was delivered on December 10th . On January 14, 2005, the picture on the television stopped working. The diagnostic reading showed that the lamp was broken. I called the service center who arranged for a technician to come out on January 17th (service center ticket E7814526). The technician arrived but did not have the correct part to replace the lamp, and had to order a new part. At that time I requested a new television and was informed that I was past the 30 day exchange policy (4 days past). I was told there was no bending of that rule, and at that point there was nothing else I could do. I was upset, and when asked to speak to a manager in the United States, one was not provided.

On January 25th, the technician returned, again with the incorrect part. Again I called the service center and my problem was escalated (ticket IM104156). I spoke with Cathy in the warranty department who put a claim in for me. At that point I was told to expect a call within 2-4 hours with an answer to my claim. I never received that call, but was contacted by the technician saying he could come out on January 29th with the correct part. On January 29th, the technician was still unable to fix the television. On January 31st, I spoke with Cathy again who said there had been no response to my claim.

On February 3rd, after attempting to contact the warranty department directly (with no returned phone calls) I called the service center and was notified that another part had been ordered on February 2nd and I would be contacted when the part arrived (in 7-10 business days).

What good is a warranty if after multiple attempts to fix a BRAND NEW television, they still refuse to replace it? At this point, I am seriously disappointed in Circuit City. I have purchased many products from them and have never had a problem. I am seeking a new television or a full refund of the television ($2,799) and a full refund of the warranty ($400). I am seeking $50 for the non-usage of cable television service while my television was not working. I am also seeking an additional $500 in lost wages for waiting multiple days for the technician.
