We bought and paid cash for our house in 1997. Due to extra repairs needed, we took a loan on our equity with Associates in 1998.At some point, Citi fin. mortg. bought the contract.

When we took out the loan it was explained that due to our age we, by Texas law, filed for Tax Exempt status and were allowed to claim this. 2 yrs. later when I opened our statement there was a 5109.00 escrow account negative balance upon inquery I was told they had paid the taxes, and we were to repay them. I explained the exemption to no avail. Now after fighting this for 3 years they once again paid the taxes making the bal. 10510.

I have never been late on my mortgage payments, they have always drafted my account. They have stopped drafting the account and are sending me forclosure notices. I have paid them by phone to avoid any late fees. I am 72 years old and by law they cannot sue me for the tax that they have paid. The director of the tax office has written them they have tons of copies of the law, and still I have a fight with them each month.
I would be interested in joining a lawsuit if available
