Citifinancial Company will not send any papers of debt owed. ripoff Irving Texas
My father had mortgage with this company, he was in default of the mortgage for 5 years citifinancial did not try to foreclose on this loan for some reason. I have spoken with several people at the company on this matter only to get nowhere. I was told that I have to get the house apppraised and sale it to pay them what I sell it for. My father tore up all papers pretaining to this loan so I have no idea what the agreement of the loan is or what is owed. I was given the pay off amount which was 7000 dollars more than what I thought he owed. I requested a copy of the papers only to be told that they didnt have any.
The person on the phone was very rude and asked why did I need to see any papers. She proceeded to tell me that there is a lein on the house and it has to be paid. I feel that I should at least be able to see the papers before I pay anything. If anyone else has had a simalar situation please inform me.

Call/go to your county courthouse where you father's home is and ask for the department that handles liens on real property. You should be able to get a copy of the lien as it is public record,
Deal with the company that hold the lien in writing only.
You may need to seek the advice of a real estate lawyer, depending on the complexity of the situation. Most lawyers will do a free consulation and this can be a good way to get some direction on how to proceed. You may have to hire the lawyer on a per hour fee basis to have the matter properly handled.
