Citimortgage took over my mortgage from First Nationwide in April 2003. I want to mention the fact that I did not receive a "Servicing Transfer Statement" from First Nationwide or from Citimortgage telling me that my account from First Nationwide was being taken over by Citimortgage.

According to their collections dept. they claim they did not receive our first three payments. We have copies of all the checks that they cashed and the dates that they posted. They were not applied to our mortgage and are just floating around in "unapplied" funds accounts.

They have reported to the credit bureau as past due, causing a decrease in my credit rating. When Citimortgage took over our account they did not get our homeowner insurance information so they automatically charged our escrow account for hazard insurance creating an escrow shortage. Citimortage insurance dept. has our insurance info but collections will still not take off the hazard insurance.

This has added 300.00 to our mortgage payment every month. We sent a letter to their investigations unit with the inquiry number, and customer service and collections do not know what each other is doing, or know nothing of the investigation. Since Citimortgage took over FirstNationwide there have been many accounts in disarray.

In response we are filing complaints with Hud under the Nation Affordable Housing Act, the Correspondence Branch of the Federal Trade Commission. Also I am protecting my rights under the Fair Credit Reporting Act, The Truth in Lending Act, The Fair Debt Collection Practices Act, and also under RESPA (Real Estate Settlement Procedures Act) and any other legal means at my disposal. We are also contacting our state representative and congressman. We are tired of being threatened by Citimortgage collections department and are doing everything we can, including legal representation, to correct this situation.

Please contact me with your comments and read my report dated 1/18/07 titled as CitiMortgage forcible entry and unlawful trespassin... we all have this in common that Citimortgage needs to be stop. we need to come together to do a class action suit. Please keep all your paperwork as this is your proof of the conduct of Citimortgage.

Or, if you have all ready been in trial all your paper trail that leads up to taking your home in the future, present or past will be benificial to do a suit. Make copies to have on hand. 2004 went in history it was foreclosure maddness year homes were being taken left and right. Creditors were jumping out of chapter 7 bankruptcies and getting liens and attaching them to homes some without the owners knowledge. And, Attorneys for mortgage companies using credit reports with these creditors in them for fruadulent purposes in Foreclosure litigations to help in seizing your home.

All Mortgage Companies are not Corrupt as well as our justice system. But, where there is Corruption we must stand and put a stop to it we must come together in numbers and everybody will listen.

A suit under RESPA ACT is a go tell someone in this report to become a part of this.The Attorney General is a good place to do your complaint

A suit under your Constitutional Rights under the 14th Amendment under the due process of Law Clause is a go too. Especially, if you have been a victim of Financial Institution Fraud. So, put on your sherlock holmes hat and put a magnifying glass in your hand and do some reseach at your court house to see if you have some liens attached to your homes that you do not know of. and go to your city of treasure and do a complaint and also do a complaint at the Head Quarters in St. Louis Missouri at the City Of Treasure there.

I do understand where you are coming from. We had an issue when we closed with Citi. They actually sent the wrong docs as well as a wire transfer. We actually had two 2nd mortgages last year, although no papers were signed.

We had there collections contact us, but never was it reported late after 3 months of going back and forth. We also got everything straghtend out pretty quickly, after the title company admitted that they had the extra funds in there account and did in fact receive 2 wires, but never returned one.

We did receive several collections calls, but all resulted in them reading notes and they were always pleasent.

If you need to speak with someone there and don't get a good answer speak with the supervisor.
The key to getting anything done is being patient, courteous and persistent.

Quite frankly if I was a customer service rep and have had customer yelling and screaming all day, a patient pleasent customer would get better attention.

I was just wondering if the folks in Florida founda reasonable solution to their troubles with CitiMortgage.


We are having our own problems with them, such as they are placing any payments we send them on "hold", and then when we send them proof that the payment did indeed come from our account, they will credit that payment, and then conveniently "lose" another payment.
I would really love to hear from anyone that has a complaint with CitiMortgage as to whether there have been or are any class actions in progress, and it there are any lawyers out there willing to deal with these people.
