LETTER TO MCCAIN AND CITY

Dear Mr. McCain,

I am writing you concerning the misappropriation and use of the vehicle code in Glendale Arizona.

In June 2004, I received a traffic ticket for violating Section 28-644.A1 "Failed to Obey a Traffic Control Device" by Officer Robbins.

I had driven to my son's school to pick him up. As I came around the corner, I saw him walking up the street. I pulled up to the curb and stopped just long enough for him to safely enter the vehicle, approx 200 ft. behind a no parking sign.

Office Robbins pulled me over and cited me for Section 28-644.A1 "Failing to Obey a Traffic Control Device". I asked where the traffic control device was and he stated it was the no parking sign 200 ft in front of my vehicle. I stated I should be cited for a parking violation at worst and not Section 28-644.A1, a moving violation. Although Officer Robbins was very courteous and professional, I felt he had not correctly cited me for the correct violation.

I challenged the summons in a Glendale court. In court, I clearly stated a "device" is something mechanical or electrical in nature. I was shocked when the Judge sided with the officer and convicted me with a moving violation (although I was parked) and a $131.00 fine. Clearly, something is going on with the mistreatment of motorists in Glendale.

I surely hope the Glendale police are not writing parking tickets for running red lights (a real traffic control device).

You must have been a real a-hole to the cop or had a bad driving record, if you were nice and contrite, and had a clean record, you probably would have received a warning.

He got you for a moving violation because you were behind the wheel of the car and most likely mouthing off.

I also think that identifying a cop by name on a website viewed by millions, and accusing him and the police department of incomptence certainly isn't in your best interest. As a matter of fact, you may want to get a closet full of disguises.

Per ARS 28-601 definitions:

10. "Official traffic control device" means any sign, signal, marking or device that is not inconsistent with this chapter and that is placed or erected by authority of a public body or official having jurisdiction for the purpose of regulating, warning or guiding traffic.

I'm sorry about your ticket.
