On Nov 28, 2009, I located a tvshow DVD set ordering company through Amazon.com called clickDVDmedia, AKA clickDVDstore and placed an order in the amount of $53.90 which shipping and handeling.  On the next bussiness day I recieved an email from anthony smithson [anthony.smithson19@gmail.com], citing the charge would read: What-a-deal on my banking statment which cleared on Dec 2, 2009.  After waiting nearly a month I attempted contacting the company, *note: there was no contact info, just an online contact form to send inquiries.  My bank filed a fraud report on Jan 4, 2010.  Results are pending

The fraudulent charge report on your credit card will dispute the charge with Amazon, this will result in a chargeback to the seller, the seller will be asked to prove it's legit which he won't be able to do on a fraud claim.  If the credit card company disputed saying not fraud, but dissatisfied due to no product or service provided.  Amazon will issue you credit from the sellers amazon account and not ask that anything be returned.  If it's disputed as fraud, Amazon will refund and not deduct from the seller's account.


If it was reported as not received, the seller must provide proof.  If he shows a delivery confirmation tag from USPS, it's unlikely that Amazon would side with him.  If it's a signature confirmation from USPS, or a delivery from UPS, DHL, FEDEX etc that obtained signature, it will be closed in favor of the seller and you're claim will be denied.

So:

Fraud:  Amazon.com is at fault for not protecting the credit card information on the sale

Dissatisfied: Seller is at fault for not providing product or service

Non-Reciept: Seller is at fault for not delivering goods as promised.  It's their responsibility to get the item to you, even if the courier looses it.  SO MANY SELLERS on Am and Ebay will say "It's not my problem once I give it to USPS,DHL, FEDEX, or UPS".  If you ever get that response, just file a claim because it is their responsibility to get you your items.  Imagine if Walmart, Target, Tigerdirect etc handled problems like that.  "Sorry the shipping service that I CHOSE to send your merchandise failed, but that's not my problem, take it up with them".

You will get your money back.
