TheOn March 16th we entered into a lease agreement with Cluff Real Estate and Property Management for a beautiful older home in Mesa Arizona. We were promised the home would be cleaned and repairs made prior to move in. On March 18th we started our move in Journey. Upon final move of our belongings we started to notice odors coming from areas of the home. The home was in need of cleaning and there looked to be blood substance on the wall in one part of the house. The wood floor in the bathroom was eroding, the bathtub spout did not work, there were no fire alarms in the house anywhere, screens to windows missing, broken window to garage, and many other small things. We contacted JAMES ISREAL whom was the person that showed the home and took our cash payment. Also there was a cat whom later was discovered left by the previous tennants. This cat ran into our home and hid where we could not locate it and had to leave it in the house while out. We were contacted by email by DANO SHREEVE about a breach for this cat. Come to find out the OWNER MARLENE WRIGHT had done a surprise visit and was seen peeping through our windows! Here is the first set of emails....

Jason & Marina, It was discovered last week by the owner that you have a cat at the property.  Per your lease, the lease states that no pets are allowed!  You mentioned that you might have some fish and I said that should be ok.  As for a cat, it needs to be gone asap or you need to move.  The owner is willing to go to legal matters over this if it comes to it.  I would suggest removing the cat as soon as possible. Hi Dano,

Yes there is a cat that has shown up in the back yard. I never lied about the pets rule since i didn't have any. I contacted the humane society and they will not come for the animal and that I have to drop it off and pay a fee. It did get into the house and has been friendly and therefor I have found a home for it and It is going to be relocated this weekend. Specifically on Saturday. Rest assure its outside. Never the less This isn't OUR cat and really isn't my responsibility but i do not want my kids letting it in either and I don't feel i should be required to pay a fee for something that's not mine.

Now with that said I am looking to adopt a dog. She is small and older and there for potty trained. I would like to request permission to allow me to adopt her and give her a home. I also would like to know the fees included. I would be willing to pay a pet rent of 20.00 max or if a deposit is needed then the ability to cut the cost into payments.

Also I was told that the landlord stated something about lying about pet sitting? This is another thing to discuss. My mother in law sometimes not often but sometimes goes out of town and we usually watch her dog. She is a German Shepard and she is 3 years old. Is this an issue as the duration of stay is only 2-3 days.

Now the issue that i have to bring up is the "peeping through the window" thing. What if I was there nude when the landlord peeped through and why couldn't we take care of what she did outside since we are responsible for maintaining the property? I did not know that the landlord was able to just "drop by" and look through the windows when a tenant lives there.

In response to the irrigation situation...yes...I would love to have the Landlord/ owner of the home come to show us what we need to do. It seems like a good idea that she meet us since she sounds very curious. But with notice of course. I hope this will extinguish all assumptions.

NEXT and most importantly the condition of the home. We did not complete a walk through and I have spotted several areas that I need to disclose so that I do not suffer damages if they are not fixed. I was told the home would be cleaned and i feel that you might want to find another cleaning service. The shower door covered in soap scum, sticky substances on shelves in laundry room and kitchen, what appears to be blood on side of kitchen, and the worst part is the unbearable odor in the master bath. I am pretty sure the previous people kept a pet locked in there because of the odor and the scratches on the sliding door at the bottom.

The list is as follows...Master Bath- Bathtub Faucet broken  flooring by tub damaged and large spaces between boardsMissing light fixturesDishwasher- Very loud sounds like it may break if usedDryer- does not get hot...removed and placed in garagepaint is incomplete in some areas of the homescreens missing from front  security door and kitchen windowRefrigerator has shelves broke or missingGarage doors- Never received openersMaster bedroom closet door knob brokenScuffs and scratches on the bedroom doorsGate in back yard to alley is dead bolted and no key was given

Please forgive me for not receiving your calls yesterday. Wasn't a well day for me. Please let me know if there's anything i need to do as i do not want any issues. I am happy with the neighborhood and home and would love to stay as long as possible. Thank you, Marina Love

Hi Marina, We have talked to our handyman and he will make the necessary repairs to the property.  Let me know if he doesn't contact you within 48hrs.  His name is Alfonso and his phone number is 480-593-3798.   Also, regarding the dog situation I talked to the owner and there are a few requirements before the owner will allow the dog.  She wants to know the size, breed, age, etc.  She also wants to see a picture and she wants you to sign an addendum stating that the dog would be an outside dog.  You would also have to pay an extra pet deposit.  Let me know if you are still interested under these terms. Hi Dano,

I wanted to find out if we were going to be receiving garage door openers? unloading grocery's was interesting and would have been great if I had one. I haven't heard from the handy man but hoping to tomorrow since I am home all next week. My pay had to be modified so i will be able to pay rent on Friday. I understand and will pay all late fee associated. I don't know if there is an electrical issue with the microwave or that its just old but it runs and then powers off and turns back on. I lost a home due to electrical problems so I definitely want this checked out.

Now this cat issue has become a problem as Friday night I had our back door open while cleaning and a very large and very scary dark grey cat jolted into the house!  We had to chase it around the house as with the other one however this one was aggressive. Did the previous tenants have cats cause maybe the left them behind? This cat seemed to know where to run.

As for the dog....I do want a dog now for sure. Even though she is little she can ward off the stray cats hopefully. I have attached some pictures of her. I am unsure of her breed. She is a mut. Possible terrier or something. She will be outside mostly but she would be a part of our family and not just some dog we don't love and leave in the yard with no regard of its presence.

She is medium in size but closer to being in the small category.

I know rent be late doesnt look good and it wont be a problem but the move cost us a lot and i have yet to recieve my deposit back.  I dont think i am getting it back since the home is foreclosed.

Please keep me updated on the repairs....and are we signing a walkthough? and what does the landlord say about the dog?

WOW! 350.00 for a small already trained dog? What exactly does that cover? Is this refundable? I  am  sorry I haven't gotten back to you sooner your email was hidden in the sea of junk i get in my inbox. I wanted to tell you all my check didn't arrive on Friday or Saturday like was supposed to but should be here today. Please let me know total cost up to today so i can get a money order. I do have some serious concerns. I don't mean to be a problem but there is something wrong with the electric. The whole house electric went out twice this last weekend and after the first time the lights now flicker. The microwave shuts off all of a sudden and doesn't come back on for a while. I lost a hm to a fire and i am not wanting that again  which brings me to the next area. Fire alarms. there is only one hung and that is because we bought it and hung it. Now the handy man called and said he was coming on Thursday and he didn't show till Friday at 7am. He walked though with us wrote down some things and told us he would be back after a trip to home depot. He no called no showed. Did you know there are only 4 3pronged electric outlets in this house and 2 are for the washer and dryer? Not a selling point.

I dont mind paying a deposit but if its refundable. Like i said this is a small trained dog. A pit bull puppy yea understandable. I can do 150 now and 150 next month? If not forget it. I need to have some breathing room after my work just caused all these late fees with you.

Marina, The owner said that she would allow the dog if you added $350 to your security deposit.  Once we receive the deposit, you can have the dog.  As for the repairs, I will make sure they are done in the next 2-3 days.  Can you email me the best phone number to reach you and I will make sure Afonso calls you to coordinate the repairs.  Let me know if you have any questions. ALfons their matenance man who did not know how to do anything cuts a huge hole in the ceiling to find out what the electrical issue is and he concludes its the microwave. This was with the property and not ours. So he unplugs the microwave and says to not use it. Suprise that didnt stopp the breakers from flipping and the entire house going out. The lights went out while 5yr old and 4 yr old were bathing and all i heard was screams coming from the bathroom they were terrified! I ran to get to them unable to see and slammed into a wall hitting my head which left a huge egg sized not and bruise. Called ALFONSO immediatley and told him this needs to get fixed.

Since the April email notifying of the electrical problem we have documented dates and times of these outages. There have been over 170 outages in a less than 3 month period!! After numerous attempts to get them to fix it finally an electrician was sent out accompanied by JAMES ISREAL. James stated that we would have to stay somewhere else for 1-2 weeks while the repaid was being made. No offer to set us up anywhere. At this point we refused to pay rent until it was fixed and planned on vacating. We were assured the problem would be fixed. After that another electrician came out and told us that the whole home needed to be redone and that we would need to vacate for a period of time to fix. The repair would cost in the thousands! We have heard nothing but "I will send someon out within 48 hours" constantly and there would be no show...then days later someone would show but without notice. We notified them that we wish to vacate in paticular JAMES ISREAL who said to call him when we need and now was saying to contact DANO SHREEVE instead. We served a notice to fix or quite and just so happens the same day they serve us with a pay or quit.

Now who do you think the judge sided with? We did as the AZTENNAnt act stated we should in the event of this happening and still we are required to not only pay 1700.00 in legal fees and rent costs but since we did not do a walkthrough risk CLUFF REAL ESTATE claiming the home damages that were already there on us so we do not get our deposits back. WE filed an answer and a counterclaim. The judge did not acknowledge either. Looking through what CLUFF had gave to the courts and us found a document that stated "Tennants acceptance of Service" for the service paper work that was dated 6/6/2012! It was signed and found the signature resembling was indeed CLUFF himself! The funny thing is that this same document not only was forged but the dates were manipulated so that they could win in court that they gave us notice when they did not! We did not get any noticed until June17th 2012.  We found out that this home has been rented out to 7 different families in the last 3 years alone!!! This is unjust and I am defintley not going to let this go. We have had our electric provider out whom said the home was a fire hazard and unsafe...in violation of code. The home is not listed with the assessor as a rental. another violation. Violations of the landlord tennant act of arizona for not maintaning the home and making it a safe dwellling. IF YOU WANT TO LOSE EVERYTHING IN A HOUSE FIRE THEN THESE ARE THE GUYS TO GUIDE YOU TO THE PERFECT HOME! The owner of the home just sat in court smug thinking of her mormonism and not of a family. Thinking of money and not of the childrens wellbeing. Looking at their website I can see that they will do anything to keep the homeowners happy. even if it means screwing over good people.
