After a horrid hurricane season we were finally getting back to normal in South Florida and looking forward to a sunny Monday morning.

As we welcomed the early morning post, a certified receipt was placed on the desk for signature. After signing it we turned the manila envelope over, it said "Subpoena."

Opening it we discovered that Ms. Jana Castro, Deputy Secretary State of California and Ms. Karen Bascos, Director of Accounting for Cogent Road of San Diego named our company for $2,000.+ in unpaid invoices for a credit software program.

Well, we do deal with major credit agencies et al but we do not use a software program. As a licensed Mortgage Lender for 35 years, we work directly with recognizable reputable national lenders and credit agencies.

We thought surely this is an error. Our misconception. Numerous inquiries and letters to Cogent, their accounting department and officers proved futile. We were asking for the documentation they referred to in their subpoena.

Fair we thought. "May we have copy of the contractual agreement and copies of the billing in question?"

We were told that our company telephone number and FAX was not the same as the FAX number they had on their records They further refused to give our accounting department person information because their records indicated a totally different person. So we asked "Well, how is that our name is on your subpoena and not the people you claim opened the account?" No answer and no records forthcoming.

We have written the State of California to report this incident and have asked how the government could possibly issue a subpoena when there apparently is a huge discrepancy. A discrepancy that COGENT ROAD (Funding Suite Software)is very aware of and yet refuses to correct to substantiate their claim.

Our experience has been that when dealing with reputable companies who provide documents as sensitive as CREDIT REPORTING - That a responsible company/agency will do a physical inspection of the requesting business, a corporate credit report and background check prior to permitting use of any of their services.

COGENT ROAD, we believe, is not a a reputable company based on our experience. As of this wrting we have still not resolved this issue to our satisfaction nor have we received documentation supporting same.
