I have been paying Cohen McNeile & Pappas for almost a year now. Starting in mid July I was on disability leave from work. I had a couple medical conditions I was dealing with and still currently am. I went back to work mid August and hadn't even been back a full month as I had just received my first full paycheck. They decided (the day before my birthday) to garnish our joint bank account. This was on a Tuesday, 3 days before my husband's check was to be deposited. They did 2 transactions. One for $443 and the second for $110. This drew our bank account negative. We had nothing left to get gas for work, food for our daughter etc. I never received a phone call, email or letter about any of this. The following days I made numerous calls from the "law firm" and to our bank. The law firm said they could do nothing until they had an answer from the bank. The bank had no idea what was going on and was no help. I called and talked to 4 or 5 representatives.

By this point I just wanted to make sure my husband's check wasn't going to be touched Friday. Otherwise we are looking at not being able to pay rent, electricity, gas or even food! Finally, the last representative understood my concern about my husband's check. They already took $500 and cleared us out, we needed my husband's check. She proceeded to tell me that the other reps I talked to I must not have mentioned that I was asking about my husband's check because if I did the other reps could have told me that I can get proof that it was my husband's check going in Friday not mine and fax it to the law firm. This is Friday about 2 in the afternoon. When I asked why the other reps never told me this she said reps don't always give you information unless you say or mention specific words. Like special trigger words I'm supposed to know to get specific information. She proceeded to tell me she would file a complaint for me, which I've still not received any kind of email or other confirmation that she did. I make my payments monthly and I understand now that I missed a payment while on disability but send me a notice or something. Don't take everything we have....especially taking away from my daughter. If I had the money I'd hire a lawyer. Since I don't I'll have to deal with what happened. I just want people to know how these people are!

The law firm can garnish your husband's check. If they have a judgement against you, it can be served on any and all accounts that you are listed on. And unfortunately, once money goes into an account, it's considered your money. The only exceptions are for Social Security/Disability payments. They are not garnishable except for federal debts. I hope this works out for you.

You may want to consider having your husband open a new account for his pay. Either do not list you on the account or list you as Power of Attorney. This will allow you access but not allow the account to be garnished.
