In a 6 month Exclusive Listing Agreement, Edward Schaerer (the listing broker)waited 4 months after the signing and had a friend Bart Caso, (who is also a realtor and never disclosed it) act as a buyer for properties we listed with for sale with Community Real Estate. The buyer offered full price sight unseen with a 7 day right to cancel upon inspection. None of the contracts presented were agreed upon and were not signed by us as the sellers unless it was correct. Yet, Edward Schaerer and Community Real estate threatened us with several phone calls and letters to pay the commission followed by several letters from their attorney. We were quickly sued for the commission. Since we did go into trial Pro-Se, we lost. We did however appeal.

How many Realtors would actually write a 3 page letter to the sellers right after the delivery of the 2nd contract and threaten to pay the commission?

Our property was never placed in the Multiple Listing Service as required when you are a member of the Board of Realtors. The properties were never advertised anywhere. NOT ONE CENT SPENT!!

I still cannot believe that there are such cruel people in this world such as them. This Company should be out of business and this agent should find another career away from the public. NO ONE should endure the stress and financial pain that they have caused us. They all knew exactly what to do collect the commission without consummating a sale! They beat the legal system and they knew exactly how to do it.
I WILL DO EVERYTHING IN MY POWER TO MAKE SURE THAT THESE PEOPLE WILL NEVER DO THIS TO ANYONE ELSE! WE HAVE SUFFERED AND THIS HAS NOT ENDED YET!!
I just had a baby and also suffered a stroke 3 weeks after signing the listing agreement. These people could have killed me!! Anyone being threatened to pay $35,340.00 just for one signature would have dropped dead. They are greedy and all they cared about was making money. They wouldn't allow me time to evaluate what was wrong with me and instead they kept on sending letters and calling to sign or pay the commission. This was making me even more sick!!! After several doctors and an M.R.I, I was finally diagnosed with having a stroke. I asked them for time to review the contracts because of my illness and they didn't believe me. My health comes first. I offered to show them my doctors bills and evaluations, but it didn't matter. I later find out if you are a transaction broker, nothing matters except the listing agreement. I WAS SICK!! But in the eyes of the court, I should have reviewed and signed anything they asked me too because that should come first. AGAIN, YOU COULD HAVE KILLED ME!!
