I'll try to make a long story short.(impossible) I bought a manufactured home and land package financed by Conseco a couple of years ago. Due to a job transfer, I had to move out of state. After listing the home with a
realtor, I found out that Conseco is/was well-known in the industry for loaning more than they should on properties, just to get the business. I
trusted that they and the company who sold me the home knew what they were talking about, but it appears after the realtor valued my home at around $25,000
less than they did, I was wrong to trust them (as well as the seller).

I have since rented the home to two different families, both of which skipped out owing me payments. Because of this, I called Conseco today to discuss the possibility of a voluntary foreclosure. I spoke with my account rep,
who has always been helpful in the past. She passed me along to a gentleman(I use that term loosely) whose name is Phil Zaffarano. (Little Rock, AR
office).

He began the conversation with - Hello Ms. Brown! I hear you're in Florida (that's where I live now). Just wanted to let you know that you
need to stay there. Don't ever come back to Arkansas. Go to Walmart, visit friends, get a tan, do whatever you want, but don't come back here.
(This is only a small part of the insulting, unprofessional things he said to me,including questioning my intelligence).

He informed me that he would go to my property this week and change the locks, told me not to go near the
place or he would have me prosecuted for breaking and entering/tresspassing or some other nonsense. He told me I would not be able to buy a pencil on credit after they were finished with me. He also informed me that I would
hear from them in the form of a lawsuit for the full amount of the loan within 30 days.

I called this company because I am in a bad situation and need to find the best way out for all of us. I was treated as if I were less than human. Are there no decent people left in the business world? I plan to
explore futher as to the legality of the things he told me.......

Melba, if this comment gets posted, I just wanted to write to you and give you encouragement and tell you to hang in there. This guy was completely off the wall and hateful. It takes a great act of courage and decency to call someone and tell them you wish for them to repossess the place.

You do need to get a lawyer to sort through the things that he threatened you with. You can go back on the property accompanied with a sherriff to get any personal items and furniture you left behind. He cannot stop you from doing that.

And for what it is worth, a repo stays on your credit report for seven years and then it is removed and you have legal remedies to fix your credit. Also one other thing. I may be wrong and I am in a similar situation. We are cosigners and we let the mobile home go into repo because we could not afford at the time to pick up the lot rental plus the mortgage and all the expenses plus we lived out of state and we just didn't have the resources to do it.

I really believe that your credit will be restored in a few years after this is all over once you have again established a pattern of good behavior. Just write a little note of what happened and let the future creditors make their own minds on you as a person and as a risk. I really believe that Conseco Finace has very little credibility in the finance world and they are known for their shady business practices and their high default rates. I really doubt that creditors are going to give their negative reports in your credit file all that much weight.

I mean it is like asking Anna Nicole Smith to speak on the virtues of virginity. Please consider the source and I will keep you in my prayers and please don't get discouraged.
