Consumer Portfolio Services (CPS) In., repossessed my vehicle in September 2017. The transmission went out due to a faulty (recalled) CVT component. The vehicle was a 2013 Nissan Altima. I was unable to afford the $4 - $6K required to repair the car. Nissan refused to repair the car because the 3 year, 60K warranty was out. It broke down with 60,198 miles. Virginia law : Title 8.9a, SS 6.2-2217 & SS 6.2-2216, states that a lender must provide the borrower 10 day notice prior to the repossession date ( never provided to me). CPS did not list a date, time, or location for the sale. CPS called my phone number utilising several spoofed numbers in an attempt to mask their identify. CPS contacted a reference that was placed on their "Do not call" list. CPS did in fact call this person on numerous occasions and disclosed to them that I was behind on my payments ( violation of the Fair debt collection practices act (FDCPA)). Never deal with CPS...and ensure that they are abiding by consumer protection laws...both federal and state specific laws. If you believe CPS is in violation of federal law don't contact the BBB, contact the Federal Trade Commission (FTC) and your state regulators.
