We have had our truck financed with cps since 2005. We were making our payments on time until April 2007 I asked for a deferment, we lost our house and i couldnt pay the payment. They did agree to it. Everything was going well, I would make partial payments throughout the months my car payment was due, but it was paid on time. i have recently checked my credit report and cps has never reported my payments late. I was having trouble making april 2008 payment, i called cps the beginning of may and the lady i spoke to said i could make Aprils payment may 9 2008 and defer Mays payment, then my next payment would be due June 11, 2008. i said great, thank you for your help.

On June 5, 2008 i received a phone call from a tow company asking where the truck was because he was sent to pick it up. i asked for what, he said he didnt know but could put me in touch with someone from cps. When Mr. Sanders got on the phone I asked him what this was about. I also told him that i did call him back on Tuesday when he called, but he never returned my phone call. He said i didn't make Mays payment, it was late and they were picking it up. I explained the phone call I had in May, he put me on hold. when he came back on the phone, he told me the person that made those arrangements with me did not have the power to do so and has since been fired. He was willing to award me the deferment for a $50.00 fee and i had to post a check for Junes payment. I asked him who he could even repo the truck when my payment wasnt even 30 days late and no one ever called before this incident. He said because I am late they can repo.

Can a company repo when you are not 30 days late, and can they repo if they have not made contact with you?

I think they can repo if you are a day late. And they do not have to notify you.
