Continental Collection Agnecy has been coming after me for an apartment complex i lived at (for only a month or so) from 6 years ago. I had two other roommates (technically 3 but the other person was not on the lease), but they are coming after me for all of the balance, which is an outrageous amount.
I moved out after finding out i was pregnant, and the living arrangements were not suitable for me to stay. With mold (which i am allergic to) in the bathroom, around our toilet, and the maintenance people telling us there was no leak from out toilet (we had to leave a towel aroung to toilet to is would not go into our living room), i had to get out of there. I spoke with the apartment complex about moving. One of the office people there told us that i could not be removed from the lease, but we all could write out an agreement, sign it, and turn it in to them for their records, and i would be good to go in the future, if anything were to happen.
We 3 sat down and worte an agreement that i would continue to pay my portion of rent to them until they found another roommate. Once they found another roommate, I would no longer be liable for anything after that. We all signed the letter and turned it into the office.
Now they are saying they never got that letter (which i was there when we turned it in) and are only coming after me. One of the roommates has and will vouche for me on the letter and the arrangements we had made, and so will her boyfriend (who was the other roommate and not on the lease). They both have told me that there was someone who replaced me and took responsibility.
This collection agency keeps telling me that they cannot find the other two from the lease, but i have given them information on both. One of whom I am still in contact with, but yet they are only going after me.
I went to my scheduled court date on 5/10/16 to dispute. I was not able to file my dispute on that same day due to lack of funds, but did mail it to my city courthouse (clerks office) a few days later with an application to do payment arrangements. I hadnt heard anything back from either party until yesterday when my work got notice of my garnishment paperwork. The Writ states that the judgment was placed against me the very next day on 5/11/16. The collections agencies lawyer/attorney told me that there would be another court date within 30 days to discuss my dispute, but i was never informed of anything. Not to mention, the processor who served my paperwork, did not give it to the disignated person on my paperwork. The processor walked into the place and handed the paperwork to someone and then left.
I need help on what to do in order to stop them and get this to backfire on them.
