I spent my life savings to create a 1940's pinup calendar like the Vargas calendars. I had a website called darlingdivas.com and sold the calendar on this site. A woman named Tanya D. Noel called me and said she owned her own calendar website named coolcalendars.com and she wanted to buy some of my calendars to sell on her website.

My calendar sold for $14.99 at the time and Tanya wanted to order 50 of them and she would take 55% off of the price. I figured the more exposure the better. So I agreed and Tanya told me she would pay me $367.01 within 60 days.

That was over a year ago. I have emailed her more than 50 times, sent her payment demand letters, and after months of attempted contact by me, I received one email telling me I would be contacted through the mail with a reply within a week. That was over a month ago. Tanya's calendar business is located in San Jose and I am in Los Angeles.

My only alternative is to take time off of work and go to San Jose and initiate legal proceedings. I think it is highly unethical to take a product (which she is still selling on her website) and not pay someone and on top of that, ignore them! How could someone run their business that way?

I sent her my product in good faith and in return I get taken by this woman. Tanya D. Noel is a shady business woman and cannot get away with her deceptive business tactics. I would appreciate all of the support I can get. The email address for Tanya's company is customercare@coolcalendars.com or info@coolcalendars.com

Maybe if others let her know that this is unacceptable she might think twice before ripping off a trusting person like me.

I was contacted by Coolcalendars.com and they would like to settle the matter. I will retract my prior statement due to their change of heart in regard to paying me. I was told I would be paid in June the full $367.01 plus 10% for my trouble.
The lines of communication are now back open between Coolcalendars and myself. I appreciate their cooperation and look forward to continuing a business relationship with their company.

Hello,

My name is Marchel and I have joined Cool Calendars this year to work part-time on the challenge of implementing a quality customer care system for a company that I believe has great potential.

Cool Calendars is a very small family owned business that opened a little over two years ago.

Last year was a very tough year for many dot com businesses, and Cool Calendars was no exception.

In addition to the regular new business challenges faced, Cool Calendars was bullied by a major U.S. calendar publisher, in an effort to eliminate the competition of another calendar reseller that the publisher has heavily invested in. This cost Cool Calendars quite a bit of money which for a very small business can be and was in our case, very detrimental. We are still recovering from this and other challenges that we faced last year.

I have come on board to take care of important matters, including the Darling Divas matter. I have been looking into the Darling Divas matter for the past few weeks since I sent them an email reply in March, 2002. I have found that we never received a single order for their calendars, and their calendars are still in storage. It would have been our first choice to buy the calendars from them and just take the loss, however, we are not in a financial position to do so. Thereby, I am going to have the Darling Diva's calendars sent back to Darling Divas this month, which is customary in the calendar business to do. Most publishers take back the unsold calendars. In this case, we have no other choice but to do so, in order to close this matter. Also, their calendar has been completely removed from the Cool Calendars site.

We are sorry that Darling Divas had to encounter challenges along with us, however, this past year has been a year of pure survival for us, and many other businesses in the world, regardless of size.

We are just grateful to still be alive.

Thank you for accepting our reply.

Sincerely,

Marchel
