Countrywide Home Loans posted payment to another borrower's loan and attempted to report us as delinquent Plano Texas

Our first mortgage was transferred to Countrywide in November of 2004. Our first payment to Countrywide due 12/01 was posted to another borrower's loan which had been paid in full for a year and 1/2.

We were notified of this error by Countrywide's Collections Dept calling us non stop accusing us of not making our payment. After Bank of America sent all of the needed documentation for them to locate the payment they had misapplied we were told it would take 3 business days to correct. It is now 3 weeks later and we are again receiving threatening calls from Countrywide's Collections Dept.

Last night the Collections Dept. informed us that even if this is not fixed by the end of the month we will have a late payment reported to the 3 major credit bureaus because they are unable to waive late fees or put a stop to the collecting due to our 'loan type'. My husband, who is a Vice President of Default at a top 25 mortgage company, and I have both been in the mortgage servicing business for 10 years so we know this is not correct.

To date we have not received a welcome letter from Countrywide which is a violation of RESPA. They are also about to double pay my tax bill despite the fact that I have faxed in proof of payment numerous times. I cringe at the thought of them servicing my loan long.
