Due to ill health fell behind in my mortgage payments and Countrywide threatened foreclosure. Finally found a source of funds to help me catch up. After numerous unsuccessful tries to reach a real person by phone, was finally able to obtain a reinstatement fee amount to stop the foreclosure on my property. Then immediately sent a cashier's check by certified mail for the full amount as stated well within the deadline date as stated.

Immediately called to let rep know check had been sent that day, and called upon receiving proof of delivery, as well as at least once a week after that inquiring as to account status. Unable to contact real person,left URGENT voice messages with full return contact information each time.

Have physical proof letter was received and verbal confirmation by telephone from a Countrywide rep that they did receive the mailing , but now being told the check was "lost" , trustee was not apprised of the check's receipt (as legally required) and they went ahead with the foreclosure sale anyway. According to California Court of Appeals in re Bank of America v. La Jolla Group II, this is mostly likely not a valid sale.

Now in minimal contact with legal dept. of Recon Trust who handled the foreclosure on behalf of Countrywide and they have promised a statement that the deed is still in my name, but this has not been forthcoming.

Have been told, contradictorily, by both Countrywide and Recon Trust that the foreclosure sale is a done deal, that it is not, that the property is still in my name, that it is not, etc. etc...get a different story each time I manage to get a live person on the phone.

It's like playing roulette, though...most of the time only getting voice mail and no return calls. Countrywide rep insists vehemently that she returns 100% of all voicemail messages and stated that she can't imagine what happened and why she did not return ANY of my 10+ calls after receipt of the reinstatement check.

Countrywide rep was consistently 'short' with me, if not downright rude, until she was informed that I have a history of ill health and strokes and that the situation was putting my health in jeopardy - she suddenly became very solicitous but at the same time THAT'S when she finally handed me over to the Recon Trust legal dept...and she now refuses to discuss any aspect of my situation with me...only referring me repeatedly to legal dept....legal dept. is now playing same game and not returning calls...

I have subsequently suffered another stroke - I believe as a result of the stress and anxiety caused by this situation.

Stress and anxiety increases each day because of Countrywide's nonresponsive attitude and refusal to provide ANY written clarification of situation.

Am now looking for an affordable real estate attorney (I know, good luck...)to help, as well as other "victims" of Countrywide's ruthless and, probably, illegal tactics to file a CLASS ACTION SUIT...if you want to join me in this effort, send an email to lke2005@sbcglobal.net subject: CLASS ACTION COUNTRYWIDE.

Have read the many complaints on this site and believe that only concerted action on the part of large numbers of Countrywide victims will provide any relief or satisfaction.

As for my personal situation, am not giving up...going to win this battle if it kills me...which it may very well do.

ALMOST FORGOT...

My already overburdened credit score (due to illness cited in original report) has, as a result of Countrywide fiing the foreclosure information with the credit unions, dropped below the minimum credit score required for me to refinance, purchase an alternate property, or even rent an apartment and I am now looking at being out on the street, homeless...
