Complaint Review: Countrywide Home Loans

Countrywide Home Loans ripoff The loan was payed off and closed in September of 2004. They are now demanding we pay them back $ 2508.00 that they posted to our account in error back in May of 2002. DO NOT EVER GET A HOME THROUGH COUNTRYWIDE! THEY ARE A RIP OFF! I have contacted the Attorney General in Texas, and the U.S Department of Justice! Dallas Texas

We refinanced our homw in September of 2003. We went through closing, got a payoff from Countrywide, and cloed our account with them. In Febuary of 2004, they sent us a letter saying that we owed them $ 2508.00 for a mistake that they posted in error to our account. They had posted someone elses money to our account and never caught it until now. They are demanding that we pay them back in full two years after the fact.

We agreed to pay them $ 20.00 a month , because we were afraid they would try to take our house, or sue us. We can not afford a lawyer. We accidently missed a payment and now they are demanding we pay them back in full. From the beginning, I have thought we should not have to pay for a mistake that they made so long ago, and never noticed. I dont know what to do! DO NOT EVER GET A HOME LOAN THROUGH COUNTRYWIDE!!!!!!!!! EVER!

You received a credit from a company that did not belong to you. The credit was not due to you. Your now whining about having to pay it back. You say all the previous people should grow up. What about YOU! grow up and take responsability. Your account was paid by someone else. I would bet you'd be the first person to FREAK out if your payment wasent applied appropriately but if someone elses payment was applied to your account inappropriately you never disputed it? You just said to them uuuhhhhh this isnt mine... Sheesh. how bout YOU GROW UP!

Ya know, I cant believe how nasty, hostile and immature people are on this site. Its really sad. How pathetic. We are paying the idiots back. I am working on get the company invetigated, and I hope they get put out of business. There are so many other complaints where they have messed with people, and nothing gets done about them. To you all that have been rude and nasty, GROW UP, and act like an adult!

I would imagine there was an error or omissions statement in the paperwork you signed at closing. Another way to look at this. If you found that Countywide owed you $2508 after two years, you'd be the first to be demanding they pay you right now. It works both ways. You "accidently" missed a $20 payment and they called the full amount.

Ok dude...so you f*d up and now you are blaming others for your inability to make a payment on time? I don't normally side with Countrywide since otherwise their record-keeping is horrid...and they DON'T report to credit bureaus in a timely manner...if at all.

So...someone else had their payment posted to your account. Same as with any bank, you can't go out willy-nilly and spend that money. Why? 'Cause it ain't your's...stupid.

Did you think you'd get a windfall and skate away without having to someday pay that money? A normal person would have made their payment anyway, and then figured it out later...and letting your "added" payment count in your favor until they finally figured it out. You sound like a guy who hit the ATM and had 50 $100 bills spit out at you and then expect to get away with it. Sorry...law says it still isn't yours.

Regardless, your mortgage note will say somewhere on it that if you pay later than 30 days late, you are in default...and you are. Hope these people don't come after your house...that's their modus operandi in most cases.

So they screwed it up....even your attorney will say YOU were wrong in not paying...you don't have much of a leg to stand on here so just pay the piper and get on with your life...take a valium or something and relax. I work for a lender (not these guys) and all mortgages say that somehwere in there you are the only one obligated for your own account actions...or inactions.

If they are reputable (and they aren't) they will put your status back at even...and go from there since they were partially at fault...but in the long run, a quick check of your own checkbook or bank statement would have prevented this fiasco.

Don't bother wasting money on an attorney...that'd be good money after bad.

Well, to let everyone know, we are paying them pay a small amount at at time. I still don't think we should have to pay, especially since this was never caught, and the loan had closed. I do have some good news. I have gotten three letters from three different Federal and State offices that are looking into Countrywide. I am hoping that they put this company out of business, and that will be the END OF THE STORY, so that no one else has to be ripped off by them! They do bad business.

I agree that Countrywide should have caught the error sooner and it was rude for them to wait so long to contact you about the error. On the other hand, you have essentially got an interested free loan on the $2508 and you have admitted that you knew something was wrong. I would repay the money and be thankful they don't sue you. A judgment against you can damage your credit rating.

Kelli, your very first post indicated that Countrywide posted someone else's payment to your account. You agreed to pay them back the $2508.00 for this mistake. You missed a payment and they called the note due.

I understand your frustration, there probably was/is some negligence going on when the mistake was made. But...If they did post someone else's payment to your account, IT IS NOT YOUR MONEY! yA GOTTA GIVE IT BACK!

You know if this went to Small Claims court, and if the facts bear out that there truly was a mistake made is a posting, YOU WOULD LOSE! You would have to pay it back. Period.

I dont care if where your wife works ( maybe she works for countrywide?). They made the mistake. All of our paperwork was fine. There was never any mention from them on our statements about the $ 2508.00, and no Im not paying crap back to them. They have incompetent people working for that company. There records are all screwed up. They told me they dont even check to see if they have the corroect account number when they are posting money to acounts. Whats that say for them ? They should be making sure they are posting to the correct account. THEY SUCK! END OF STORY!!! Why don't you get a home loan with them, ( maybe you already have one ), maybe you can experience working with them. They are horrible !

Get your credit report Fact Act which allows you one free copy of your credit report annually

This is in response to Edmond's problems with Country Wide. Since they have placed derogatory info on your credit report it would be a good idea to get your free copies that you are entitled to thanks to the Fact Act which allows you one free copy of your credit report annually from all three of the credit bureaus (experian, transunion and equifax). Check out what your reports say and if there is incorrect information file a dispute with the credit bureaus and they will get the information updated correctly, it may not be in a timely manner but the information will get corrected.

Coutrywide misposted our mortgage payment to a wrong account. It took me 4 months to bring it to there attention that they misposted. I picked it up when they contineuously sent me mortgage statments saying i owe them, after telling them and resending them the prove of payment they still did not fix it, instead they reported a negative on my credit report. I brought it to their attention, because I noticed that the person in their office wrote the incorrect account number on the front of the check, they missed it by 1 number incorrect. Despite letting Countrywide know about this over and over, they simly dont care. I finally wrote to: Better Business Bereua, contact details: BBB OF THE TRI-COUNTIES, PO BOX 129, SANTA BARBARA, CA 93102, TELEPHONE: 805 963-8657 FAX: 805 962-8557 AND EMAIL: infor@santabarbara.bbb.org. After reporting it to them, I received a call from Countrywide, until then no one bothered to call me. I believe that Countrywide should be taken out of business they really do mess up peoples lives and damages peoples credit. I feel they should be taken to the cleaners for posting an incorrect credit reporting. On top of it, they sold their loan to Amarican Servercing Company and still reported it on our report. I am not clear in the RESPA if anyone has information for me, I will appreciate it. Are they allowed to report it (besides that it was a false report due to their neglagence) are they allowed to report any lates to the cb????? If there is an attorney that can represent me I will appreciate it, they should be tought a lesson!!!!!!!!!! ENOUGH IS ENOUGH!!!!!!!!

Are you saying that because the mistake went unnoticed for about 19 months (Aug. 2002 to Feb 2004) that you shouldn't have to pay?

When you received the statement (which you always review carefully) that $2,508.00 didn't just jump out at you as being a mistake? My wife manages a mortgage loan servicing company and I guarantee there is a procedure for removing that erroneously posted credit from your account and holding it in a balancing account until all accounts are reconciled.

So, if you were the person whose $2,508.00 check was incorrectly posted, would you just step up to the plate and write another check just because the lender said you had to because they had not caught a mistake early enough?

Get over it, you knew there was a mistake 2 1/2 years ago. Make arrangements and pay the money.

I did check with Countyrwide in August of that same year. I called them to check on my account that month. They told me we had over paid and we did not have a payment due that month. I had a gut feeling that was not right, but they insisted it was. I called back that same day two more times. They should have caught it right then. I ALWAYS keep a close eye on what is happening with my morgage. I dont think that you should be judging us in anyway what so ever!!! It is Counrtywide's mistake, and their problem. I have gotten a letter from the Depatment of Justice and they are investigating. They are a rip off company, BOTTOM LINE! They have horrible business practices, and I hope they get caught, and have to pay for what they have done people. So until you have the complete full story you shouldn't judge anybody!

I have had to fight long battles against companies that tried to press large illegitimate charges against me, and numerous smaller fights with liars and thief's of all types. Beneficial Finance tried to charge us about $ 2500.00 for a loan after closing. It was an illegitimate charge and we won.

But your problem is different. That's a pretty shocking amount to find you owe after two years.

Do you really owe it?

I don't mean to be a jerk, but my point is this, if you had been closely watching your finances you would have seen that strange payment years ago. At least I would have. Saying you don't want to pay it is like saying that because someone forgot to bill you, you are released from having to pay.

Recently I received an accidental $ 100.00 double credit from a company that I was having a returned item dispute with. I intend to keep it because I hate the company, but I will not squirm if they come back and remove the credit by recharging my credit card a year or two from now if they discover it. I know it's not mine.

I would be pissed, and I would send some scalding letters to Countrywide, but in the end I would pay it because it is due.
