Dealership refused to refund monies paid for cancelled Guaranteed Automobile Protection (GAP) contract for two vehicles.

On November 28, 2011, I purchased two vehicles (2012 Nissan Sentras) from Cowles Nissan (Anna Reel) of Woodbridge, Virginia.  In order to receive a financing incentive, the then finance manager made the sales contingent on GAP contracts so the business could generate more funds, which is an act of fraud.  Moreover, I told the Finance Manager that I did not need or want the product.  The duration of the contracts was for 60 months, from November 28, 2011 to November 27, 2016.  The cost of the plans was $373.00 (contract 187737) and $373.00 (contract 187749); total $746.00.

The plans were cancelled on or about December 14, 2011, through written letter and followed by calls to the then Finance Manager and General Manager.  The cancellation was permitted by the contract terms, which called for a full refund for monies paid.

As of this writing, after numerous requests, I have been ignored and my monies were never refunded.  At one point the General Manager stated that the Finance Manager had been let go (terminated), and he would resolve the matter.  I never heard back from the General Manager, and he surely did not address the matter.

To address any possible frivolous argument on part of the business, I traded the vehicles before the end of the contract, thus a refund would be required.  However, as stated, the contract was cancelled before thirty calendar days passed from the date of receipt; therefore, a full refund is due as requested many times over.

I request a refund in the amount of $746.00.
