In 1996 I was sold a Mustang(1998) I purchased it with a 6 month extended warranty. They sold me a car knowing I had a suspended license, even set me up with an insurance agent in Poteau, OK "Farmer's" that supplied insurance to me knowing it was suspended. After 3 weeks, the transmission dropped out. It took company 1 month to pick up the vehicle off the side of the road and then one month to fix. AGAIN, in the 4th month that I had the car, it  BLEW up...literally the engine locked up. I called Twin Eagle Motors and told them to pick the piece of crap up. Here it is 2009. Yep 13 years later and CCA is suing me for $22,000 dollars on a car that I only owed $5,324.44 on. I don't understand how this is legal. I paid in advance on the 6 month warranty. It should have been fixed under the previous paid for warranty. They only received $600.00 at the auction. So, I now owe remaining balance plus 13 years of interest. Not sure which is worse: the IRS or Credit Acceptance Corp!! I know I need help on this matter. Right now in this economy I can not afford to pay the debt that I have set up with the current lawyers assisting the Credit Acceptance Corp. Had they had foolowed the LAW, they never would have sold the car to me in the first place. I would not have bought they car. Hind sight is always 20/20 though.

Before you start throwing around phrases such as "I don't understand how this is legal", remember how YOU got into this situation.


If you are saying that it is illegal for a company to sell you a car if you have a suspended license.  Don't you think that it is probably illegal for you to buy one on a suspended license?  So I would probably not use that argument in court or you will get a nice 30 minute lecture from the judge on personal responsibility, although that may not be a bad thing in your case.


However, there are other items that may be in your favor.  There is the statute of limitations, where they only have a certain amount of time to file a suit against you.  So not knowing what happened in the 13 years, such as if you made any payments or not.  You may actually have not owed the debt.


But since you said "I can not afford to pay the debt that I have set up with the current lawyers assisting the Credit Acceptance Corp."  It sounds like you may have reset the Statute of Limitations thus making the suit legal again.  This is something that you need to look into and paying a lawyer a couple hundred dollars may save you this $22,000.

I agree with Jim...There is a time limit on how long a debt can be collected.  But, if you talked to them and already set up some type of repayment plan or made any payments to them, the time limit resets and starts all over again.  Look into the "Fair Debt Collection Act" and you can get more information.  Finally,  it is not a car dealership or insurance agencies responsibility to check and see that every customer buying or insuring a car has a valid drivers license....You still are on the hook for the loan and if you crash and try to file and insurance claim, I would bet that you wouldn't get paid a penny because you do not even have a valid drivers license.  Unfortunately, Personal responsibility seems to have disappeared from todays society...Everyone is so quick to blame someone else for their own stupidity.

Without regard to the other points in this posting, there is a Statute of Limitations on debts, with some reservations.


Check this out Jen, and don't make any move on agreeing to pay anything UNTIL you check this out!  Don't forget!  Do it TODAY!!!

In 1996 you bought a 1998 Mustang?? How is that possible?? The Model was not even out then - YOU should not have purchased a car knowing that you had a suspended license?? So who is really at fault here?? And NO I do not work for these scum bags.


YOU signed a contract stating that you would be responsible for the payments on this car therefore you are legally responsible - How it took so long to find you I have no idea - Had you followed the LAW you would not be in this mess
