This company sends out letters stating it will take legal action and collect attorney fees, court costs, etc. when it does not have the ability to sue. This practice is illegal under the federal Fair Debt Collection Practices Act. The company itself is currently in Bankruptcy due to non-payment of debts related to unpaid judgements rendered against it due to its prior illegal collection activities. Businesses that employ this company to collect on their behalf may be liable for the actions of this company they have hired to do their collections and may themselves be sued.
The US Bankruptcy Trustee is suing Creditors Specialty Services, Inc., Creditors Specialty Services of Nevada, Inc. and Charles V. Stanley for fraudulent transfers and contempt of court. Anyone receiving a letter from these companies is encouraged to do research as to whether these entites have the right to collect and, even if so, whether they have any legal recourse at all or if their implicaiton that they will sue you or report you to the credit bureaus are just empty threats.
