Our pool is being held hostage by Graham George and Custom Spa, Inc. We signed a contract to build a pool with this company and specifically with Mr. George. We agreed on the pool and the price, this was back in July of 2004.

As of September 26, 2004 the pool is still not finished and Custom Spa has ignored all forms of contact from us to resolve this issue. The work on our pool came to a grinding halt when we refused to pay for an $11,000 bill for extra decking. The decking was almost all poured when Graham George showed up at our house telling us we owed him $11,000 for the decking. We were never told before the deck was poured that it was going to cost us extra. This amount is above and beyond what we have contracted for and have already paid.

We only owe one final payment due at the completion of our pool. Nothing is finished, the electrical, the gas line, even that "extra" decking isn't finished. We never asked for a bigger deck, why should we be stuck with the extra payment. Now Custom Spa Inc. will not finish our pool. We have sent them a letter, no response. We have called, no response. We did however recive a letter notifying us that Custom Spa Inc. had yet to pay for the gunite work that was done on our pool.

Now there is a lien on our property for this unfinished pool. Do not us Custom Spa Inc. Do not do business with Graham George. You will get a great original price for your pool, then he will continue to find ways to charge you more. He will keep jacking up the price for various parts of your pool with no written notice of a change. Then he'll walk off the job, pay up or else the pool won't get finished. That is blackmail.

Don't know what to believe. I assume you signed a contract to have your pool built. In that contract, it should have been spelled out exactly what work was to be done and for how much. There should have been something in there about disputes. If you sat there and watched Custom pour a larger deck without saying anything, that's your fault. If Custom went ahead and did so without your knowledge and consent, that's their fault. Contact a local attorney for some help. Good luck.
