This is a company that everyone should be aware of, just recently Cutter Recovery was bought out by McRae Arcand Foote & Associates.

They are taking money out of peoples accounts illegaly due to the fact that they are running a company without a business licence as well as not having collectors licences.

This company can not continue to do this to debotrs that owe money to they places that they borrow from, there are rules and regulations set out in every province that all businesses have to follow and they are breaking them all and on top of it all they think that they are above abiding by the laws that the government has set out.

There is a number that you can call should you not believe these facts that I'm stating here one being the Alberta Government Consumer Services Branch 780-422-1335 or toll free 1-877-427-4088. These are the people that will let you know if in fact McRae Arcand Foote & Associates have a business licence.

Nor do they have a collectors licence for the business, there for how can they go into your account with out your knowladge first and notify you of whats going on and just take funds.

As a consumer make yourself aware of everything that you sign and watch you accounts, this company need to be stoped by someone we all go though tough times and need a bit of help at times but to have this kind of fraudulat activity continue is a discrase to us as consumers and hopefuly one day the govenment will step in and put a stop to it.

The way that they are operating this so called business is not the way that all collection agencies work, there are collection companies out there that are ligit and play by the rules.

They took me for a fool and my money but if you are savy enough to check places like these out you can get your money back, speak with your bank as well as the Alberta Government.

As a consumer, it is you're responsibilty to keep track of paid debts. If you say that this account has been paid in full over 8 months ago, then it is your responsibility to provide proof of payment to Cutter Recovery, or contact your Insta Loans branch to have them track down a receipt.

As with any company, errors are made, they are not breaking any laws, simply doing their jobs recovering money owed to insta loans. If you provide them with proof that you paid, they will surely stop all collection practices.

If you don't have proof of payment then how can anyone be sure that you have actually paid this loan? It is you're responsibility to keep you're receipts for 2 years, especially when dealing with loans and large payments. They are not the only company to have errors in their systems. And there ARE people out there who like to claim that they've paid and have by no means made their payments. so if you're going to be angry at anyone, you should look at those people, and yourself for not keeping track of these things.

Get yourself a copy of the Fair Trading Act (Collection Agency). It states that no person may represent itself as carrying on the activites of a collection agency unless the person holds a collection agency licence.

Also, it would be in your best interest to communicate with these cash loan establishments to find out who owes money and who doesn't it would save yourself a big headache.

Think about it for a minute, of course the Alberta Government thinks it's fraud, McRae Arcand Foote and Associates is operating in Alberta without a licence, and it is fraud when you don't owe any money to these cash establishments and you enter my bank account.

And no I didn't sign any legal documents stating that YOU could enter my account, I signed a document with Insta-Loans trusting they would keep my banking information to themselves. Oh they must of forgot about the privacy act. I guess I'll have to get in contact with the Privacy Commissioner too!

I think this is a scam between Insta-Loans/The Cash Store/McRae Arcand Foote and Associates. Their already charging a criminal rate of interest on their payday loans and your still trying to collect even after the loans are paid.

Who's being irresponsible here. You as a collection agency should know better. I feel sorry for you guys this is just the beginning of the end. You'll be sorry that you even started to do the collections for Insta-Loans just like I'm sorry that I was so desperate that I had to borrow from LOAN SHARKS.

I hope the Government still plans to regulate payday loans with any luck it would put you all out of business.

Moral of the Story

#11Consumer Comment

Thu, November 02, 2006

You talk about how the moral of the story is simply if you borrow money, pay it back.

Well I haven't dealt with this company or owed them money for more than 8 months, so what gives them the right to even access my bank account?

At the present time Government Services is investigating. They don't deserve to get their business license. I'll make sure they don't.

Mcrae Arcand Foote and Associates represent cash loan establishments. When a debtor takes a cash advance//loan the cash loan client has a reasonable expectation to be paid back!

It is not illegal to withdrawl funds from a debtors bank account when they have signed a leagally binding contact stating that we may do so.. in the instance they do not return the funds in a timely fashion or on the date that was specified by the client.

I do agree, when you say that there are rules and regulations in every province that buisness's must follow....but the last time I checked ....these debtors are breaking the law as well

It is illegal to borrow money and have no intentions on paying it back.

It is illegal to bounce checks.

It is illegal to commit fraud in Canada!

Mcrae Arcand Foote and Associates operate in good faith, as do our clients when they issue cash advances.

The moral of this story is......DONT BORROW MONEY IF YOU CAN'T PAY IT BACK.

Don't sign a pre-authorized debit form......if you dont want the funds {that are owed to the client} withdrawn from your bank account.

What I dont understand is why the government of Alberta finds these acts of fraud acceptable!

So don't blame Mcrae Arcand Foote and Associates
for your own irresponsibility. PAY YOUR BILLS
