ARBITRATOR DECISION

Complainant, Cynthia M. Hennessey, has challenged the truthfulness of certain statements (each, a Statement) posted by Author Anonymous on the Ripoff Report website at www.ripoffreport.com on June 2, 2011, as Ripoff Report No. 735969 (the Report). Both the Complainant and the Author (together, the Parties) have agreed to submit the dispute to the Ripoff Report VIP Arbitration.

In addition to challenging the statements made by the Author, the Complainant is also challenging the status or role of the Author. The Complainant believes that the Author is a former law partner of the Complainant who is now a competitor.

Each Statement challenged by the Complainant has been considered, together with any Witness Statements and Documents provided by the Complainant and the Author, for determination of the truth or falsity of the Statement. I have been asked to decide whether the preponderance of the evidence submitted established that each Statement is true or that it is false. If the statement identified by the Complainant is determined to be an opinion, that determination will be the only determination made as to that particular Statement because an opinion can not be determined to be true nor false.

Each challenged Statement submitted by the Author is set forth below together with my comments and ruling:

1. Statement: Cynthia did some work for me on a personal injury case . . . and just pocketed the money I gave her.

Discussion: The Complainant has provided a declaration disputing the statement. The Affidavit states that at no time have I ever pocketed any funds given to me by any client. The Author had the opportunity to provide evidence supporting the Statement but did not do so.

Ruling: I find this Statement false.

2. Statement: [S]he has unpaid bills to yellow book and the yellow pages.

Discussion: The Complainant has provided an Affidavit disputing this statement. The Author has provided docket entries from a judicial proceeding brought against the Law Offices of Cynthia M. Hennessey by Yellow Book Sales which shows that on March 3, 2008, a judgment was entered against the Law Offices of Cynthia M. Hennessey. The Author also has provided docket entries from a proceeding brought against Cynthia Hennessey by Southwestern Bell. The latter case information does not disclose the outcome.

Ruling: I find that that the Statement is partially true insofar as the Author has established that at least as of 2009 sums were owing to Yellow Book Sales by the Law Offices of Cynthia M. Hennessey.

3. Statement: She was sued by [the yellow book and the yellow pages] for nonpayment of services and she has other legal actions against her.

Discussion: The Complainant has provided an Affidavit disputing this Statement. The Author has provided docket entries from a 2007 case captioned Asset Acceptance LLC v. Cynthia Hennessey as well as docket entries from a 2001 case captioned St. Louis University v. Cynthia M. Hennessey.

Ruling: I find the Statement partially true as the Author has established that in the past the Complainant was the defendant in several lawsuits.

4. Statement: She has 5 children from 3 different men.

Discussion: The Complainant has provided an Affidavit disputing this Statement. The Author had the opportunity to provide evidence supporting the Statement but did not do so.

Ruling: I find this Statement false.

5. Statement: One of her children [has] fetal alcohol syndrome which she tried to pass off as something else. .

Discussion: The Complainant has provided an Affidavit disputing this Statement. The Author had the opportunity to provide evidence supporting the Statement but did not do so.

Ruling: I find this Statement false.

6. Statement: She also has genital herpes.

Discussion: The Complainant has provided an Affidavit disputing this statement. The Author had the opportunity to provide evidence supporting the Statement but did not do so.

Ruling: I find this Statement false.

[REDACTED]. I would not recommend using this attorney, very unethical and very greedy. Upon looking into her background on CASE.NET for the missouri courts she has unpaid bills to yellow book [REDACTED]. She was sued by them for non payment of serives, and has other legal actions against her. [REDACTED]. You can see this case where she tried to do this on case.net. [REDACTED]
