Dan Diewald - Best Cabinets ripoff Took my money and didn't do the job or refund the money Chicago Illinois
On June 7, 2004, I signed an agreement for Best Cabinets furnishing of materials and labor for certain custom wood work in my condominium unit.
The total price to be paid under said agreement was $55,000.00; and as required under said agreement, I paid Best Cabinets a $25,000.00 deposit to be applied against said $55,000.00.
Without prior discussion with me and without my prior knowledge and agreement, Best Cabinets faxed to me, on October 20, 2004, a document, dated October 13, 2004, entitled Extra Work Order. Therein, Best Cabinets was charging Plaintiff an additional $56,200.00 for alleged extra work that is already within the scope of the June 7, 2004 agreement.
As a result of my refusal to agree to the alleged additional work set forth in the Extra Work Order and payment of an additional $56,200.00, Best Cabinets refused to complete the work contained within the June 4, 2004 agreement.
As of the date of this, Best Cabinets has not completed any substantial work in condominium; and what little work has been done, consisting of the installation of a few pieces of ceiling paneling, are of no value without completion of the entire contract. Said paneling will have to be removed and the ceiling repaired, at an additional cost to me.
I demanded of Best Cabinets that he either (1) complete all of the work within the scope of the June 4, 2004, agreement for the $55,000.00 price agreed upon, or (2) refund the $25,000.00 deposit paid to him plus reimbursement of the cost of the paneling removal and ceiling repair cost. Mr. Dan Diewald has refused both alternatives.
I have been damaged in the sum of $25,000.00 by Best Cabinets' retention of the deposit and the cost to repair the ceiling.
I filed a lawsuit against Dan Diewald DBA Best Cabinets on June 21st, 2005 in Cook County Court in the State of Illinois (No. 2004 L 012857). During, the lawsuit, Mr. Dan Diewald filed for Bankruptcy to avoid getting judgment against him to pay me back the money he took plus damages. I incurred additional costs in terms of legal fees.
Mr. Dan Diewald is still doing business as "Best Cabinets" at the same address.
Additionally, Mr. Dan Diewald claimed on every document that "Best Cabinets" is Licensed, bonded, and insured. During this I found out that he is not bonded or insured.
