A granite supply company referred me to a local granite fabricator and installer. The installer and I visited a granite company and I picked out a slab. He purchased the slab and a stainless undermount sink. In November I wrote him a check for the granite, the sink and a deposit for the fabrication and installation ($2500). A balance of $1000 was to be paid upon completion of the job. Shortly after that, I suffered a serious accident and broke every bone in my ankle. I was unable to continue the plans for my kitchen renovation for a few months. I explained that to him and told him that I would contact him when I was ready to continue the renovation of my kitchen. I contacted him in February and gave him a two week heads up for granite installation. He told me he would be at my home on March 3 to do the template of the countertops. He then said that he had to reschedule for the following Monday. He sent someone to do the template. At that time I was told that it would take a week to fabricate the countertops with installation immediately after. I also was told that they could install on weekends to accommodate my work schedule. I then waited for a call with a firm installation date. It never came. I called and texted. That is when I started having difficulty getting a response from him.
When I did get a response it alternated between his being busy or his being sick. Sometimes he would blame me for making him wait since November to complete the job. I explained that I had been seriously injured and had to have surgery with an extended period of recovery. He continued to offer multiple excuses to me over the course of a couple of weeks. He told me that he had a big apartment complex job that was behind but he would get to me. Then he made a commitment to come on a Sunday to install. At the time he had told me he would be at my home, he began to offer one excuse after another for his failure to appear with my countertops and sink. I knew that they were all nonsense. By 8:30 pm, I knew that he wasn't coming.
I contacted him again and suggested that it might be easier if I hired a different installer who could pick up the fabricated granite and the sink and complete the job. He texted me back that he would definitely complete the job. Then I didn't hear from him again. I finally texted him and told him that since he failed on multiple occasions to honor our agreement that he left me no other option but to sue him. I gave him 24 hours to respond. He didn't respond within that time frame. So I asked him if he really wanted to be sued. He texted me that he would install for me on April 8th between 12 and 2 pm. I contacted him a week before to confirm. No response. I contacted him the day before. No response. I called him the day of the appointment. The phone rang and rang. No answer. I called him again after 12pm and the call went straight to voicemail. I have given this contractor nearly $2500 in October. I have no granite, no sink and no answers from my contractor.
