Complaint Review: David Justin Bagnato

I purchase a vehicle through Craigslist. The vehicle was listed for sale as owner to owner. When I arrived to view vehicle it was at a business location. Test drove the car around the neighborhood but tank was empty (red flag) but either way I decided to purchase. I paid cash but when bill of sale and title was signed it was all under the business name of Scottsdale Auto Group. As soon as I drove off to gas station down the street, the car started overheating before arriving to gas station.

I called David and asked for my money and to keep his car. He refused. I waited 5 hours for tow truck. He originally had said he would help with repairs but never did.

I had an attorney mail him 4 times in reference to payment of repairs and in reference to lemon law but he refused to pay.

I took him to small claims court and I won the case. He did not show up to court and I've tried mailing him by certified mail but he will not sign for the letter and letters get returned to me. I been trying to mail him a copy of judgment and asking for payment.

Between the purchase of the vehicle and winning judgment he sold Scottsdale Auto Group, the name only. The judge stated that the new owners were not liable, but Mr Bagnato still was.

He is now working under - The Undealers. I originally paid $10,250 for the vehicle. After expenses of fixing vehicle, serving, court, etc. The judgment is for $$2,986.15 plus 6.25% interest. since 12/5/18.

I just want to get paid what court had decided.

I have all receipts, and court documents but will not post due to personal information on them.
