David Elmer is, as of the date of this writing, my landlord.  I have filed a claim against him with the Commonwealth of Massachusetts for discrimination and retaliation; along with violations of the Americans With Disabilities Act (ADA).  They accepted the claim.  This means they thought the claim was serious enough to warrant an investigation.  That investigation is currently underway.

David Elmer is refusing to renew my lease.  It is my belief he is doing this as a retaliatory act given that I have asked for reasonable accommodations here and due to losing a roommate (my spouse) early on in the tenancy.  There is much more to my claim that I am unsure if I should share here or not.  But it is time to call him out and spare any potential future tenants the pain and suffering I went through, and continue to go through.

David Elmer will say things on the phone that he won't put in writing.  On paper, he looks like a saint.  It is his 'off the record' comments that speak to his true self.

While the investigation continues, I must find a place to live rather than risk homelessness.  I am 45 years old and disabled.  I have no financial resources nor physical strength to conduct such a move.

Meanwhile, Mr. Elmer lives in a house in Nahant currently valued at $893k.  He purchased it for $750k down from $799k.  A profit of $143k in two years or so.  He is Vice President of Weston and Sampson Inc.; a Civil Engineering company.  (NOTE: This info is all in the public domain.)

Here's the thing that I cannot understand...I paid my rent faithfully every month.  Other than discriminatory cruelty, why would he do this?  Additionally, David Elmer refused to change my security deposit from my spouse's name into my name.  I had to email him quotes of the law to show him he was wrong.  To this day, it is still not in my name.

I pity his other tenants and his employees, and anyone else subject to his cruelty.

Should he miraculously change his ways, I will update this here.  I'm just glad for forums such as Ripoff Report where such legitimate grievances can be aired.

The Commonwealth of Massachusetts found that Mr. Elmer did not discriminate.  An appeal is underway.  However, there will be no further comment on this matter.  I write this because it is the correct thing to do and a necessary update.
