DavieFirestar.com ripoff abusive verbally harassing when I asked for a replacement CD consumer rip-off fraud Castro Valley and Littleton Colorado California

On August 10, 2002 my boss purchased a CD from the DavieFirestar.com booth at the Farmers Market in Campbell, California. When he finally listened to it the CD was garbled and sounded defective. He tried it on another CD player to make sure it wasn't the equipment and the same thing happened.

He brought the CD to me and had me test it on a couple of CD players and I got the same result. I called the Littleton Colorado number that was on a piece of advertisement paper I was given and someone named Dave. I explained to him the problem and he suggested that I send him the CD and he will check it out.

He gave me an address that was located in Castro Valley, California and not the address in Littleton, Colorado. When I asked him why I had to call long distance to Colorado when he and I were both in California he got angry.

He said that if there was a problem with the CD then he would replace it free of charge. I told him I didn't think that would be a problem since we had the same problem on several different CD players. Several weeks had gone by and we still had no word from them.

On October 14, 2002 I called the Colorado number again to check status of the CD and he immediately became abusive and questioning the ethics of the company I work for since the CEO was having an Admin call for him. He then told me that he had checked out the CD and there was nothing wrong with it.

Then he went into a 10 minute rant and rave about how unprofessional it was to waste his time when the CD was clearly ok and that it worked perfectly for him. After which he bad mouthed me for not checking the CD on other players. I told him that we did and he immediately came back with " then you damaged the CD and that is why it didn't work."

This was after he told me it worked perfectly. His wife got on the phone and said that she had a proof of delivery through a signature card. He got mad at her and took the phone out of her hand. I told him that I would like to know the name of the person who signed for the CD so that I could find out what they did with it.

He had a few choice words for me then hung up. Less than five minutes he called back and asked me if I take lunch. I said yes, then he asked me what time I took lunch. I told him various times.

He then asked me if I took lunch this past Friday from 11 am to 11:30 am and I said I was here. He then told me that I was the one who signed for it and that I was harassing him. He also told me that if I sued him that I wouldn't win because he had proof that the CD worked. I never mentioned anything about sueing him.

He told me that I was harassing him and that if I didn't stop calling him that he would file a harassment suit against me. I hung up.

When I came across this report I was suprized to say the least. After being so careful and trying so hard to please everyone over the years. It is Nov of 2006 and never have I had such a troublesome time with anyone. The Lunch reference is confusing. This was when the mail was picked up as we had a mail confirmation sent. The replacement CD was sent and this person seems to claim it wasn't recieved. I have a CPA in Colorado where I do mu business accounting and I travel. I keep the Cell phone number unchanged and it seems to cause problems with some clients. That is understandable. I hope others who read this realize you cannot judge a person based on one unsatisfied customer. Please visit us and see for yourself a wonderful comapant with a wonderful musical product.
