Example of contract presented to me
This is a binding contract between two parties. I, BUYER, hereby agree to and will abide by everything that is stated in this contract and if I should not uphold this contract I will pay SELLER/BREEDER of KENNEL NAME the sum of five thousand dollars ($5000.00) for damages done to her kennel name and breeding lines that she has worked for many years to establish.
I, BUYER, understand that there are no cash refunds and that deposits are non-refundable. I also understand that I am not to resell or place free of charge said puppy with anyone or at another residence any under circumstance. If I am unable to keep puppy said puppy will be returned to SELLER/BREEDER of KENNEL NAME and forfeit any monies paid to SELLER/BREEDER and contract will be satisfied. I, BUYER, have paid five hundred dollars ($500.00) to SELLER/BREEDER of KENNEL NAME and owe her a female pick of the litter back and SELLER/BREEDER must approve the male that said puppy is bred to when said puppy is of breeding age. I understand that I may have to use an outside male to satisfy this binding contract between SELLER/BREEDER of KENNEL NAME and myself. I, BUYER, agree to feed my puppy Chicken Soup for The Dog Lovers Soul and to keep up to date on all shots and wormings. I also agree that if said dog has not produced or been bred by eighteen (18) months I will send said puppy back to SELLER/BREEDER at KENEL NAME so that she can breed said puppy to her approved male at my cost which is stud fee, food and board of $15.00 per day and $20.00 per week for grooming and b***h must stay until puppies are born and ready to be sold at that time the pick of the litter will be chosen and the mother and rest of the litter will be returned at the cost of BUYER when they are of shipping age which is 8 weeks for the puppies. I will also be responsible for all Vet bills incurred while b***h is with SELLER/BREEDER and I will pay $7.00 per day per puppy for their upkeep. I will also be responsible to pay the registration cost to AKC to register the litter. If the puppies from this litter are sold buy SELLER/BREEDER I must pay her 30% of the total cost for the puppy sold out of the litter. In the event that there is not a female puppy in first litter I, BUYER, agree to pay for dog in full for the amount of one thousand five-hundred dollars ($1500.00) to SELLER/BREEDER of KENNEL NAME, and this contract will be considered satisfied. I am entering into this contract with SELLER/BREEDER and not my husband and he has no say in any way of what is to happen with the sale of said puppy. I am not authorized to sell said puppy under any circumstances as I will be charged a large penalty and I agree to this whole heartedly and I also agree to this by signing this contract. I agree to never use baby diapers on said puppy for house training. I agree to never hit or yell at said puppy at any time. I agree to take puppy to regular Vet check ups and to keep SELLER/BREEDER informed at all times of how said puppy is doing and the progress of said puppy coming into heat. I agree not to breed the dog until her second heat and I agree I will not breed her every heat. I, BUYER, agree to be responsible and judicious breeder and to make sure that I protect this blood line but to also protect the said puppy from any harm that might befall her. I agree that said puppy will have a fenced yard and a life in the house as not only a breeder but as a loving companion. I am never to sell one the puppies from this b***h as a breeder without prior consent and approval from SELLER/BUYER all puppies must be sold on a spay and neuter contract and on limited registration. If this is not upheld I, BUYER, agree to pay SELLER/BREEDER the sum of five thousand dollars ($5000.00) in damages to her kennel name and her blood lines. I agree I shall never sell to pet stores, brokers, or puppy mills for any reason at all for life of the dog, if I do, I agree to pay SELLER/BREEDER six thousand dollars ($6000.00) for damages to her kennel name and her blood lines. I also agree to buy an approved male to breed this female after her first litter is sold. Said puppy is never to be bred to the males that I already own for they are not of equal quality. By signing this contract I am not disputing anything in it and I am of sound mind and body and not under any type of duress or pressure to sign this contract. I, BUYER, agree to everything in this contract and will abide by it for the entire 16-18 year life span of said puppy.
I SELLER/BREEDER will agree to sell said puppy to BUYER upon the signing of this contract and if contract is not signed BUYER forfeits all monies paid to SELLER/BREEDER at this time. This will conclude all transactions between these two parties and there will not be anymore contact with BUYER and BUYER'S KENNEL.

NON OF THESE EMAILS ARE DOCTORED.
I was emailed by Dawn and told she was not going to send me the puppy, and that she does not give cash refunds on deposits. I believe that Karen and Dawn both did this so that Dawn would not have to send me a puppy and not give me my money back. Since this has happened Dawn has posted a report on me that states that I do not own any of my dogs, or have them registered to me, and that I have bought and sold several. She is telling everyone that will listen that I only made a deposit and that the puppy was not paid for in full. The actual agreement was that I would put $500.00 dollars down and then I would breed the female with an approved male (approved came after I sent the money) and give her a puppy back. The following emails state this. I sent her one payment of $250.00 on April 30 of 2004, and a second payment of $250.00 on July 1, of 2004. I kept asking her for a contract, but didn't receive one until August 29, 2004 almost three months after I sent her my first payment. The following is what I understood our agreement to be (these are unedited emails between both of us):

The next girl to be bred is Isis and I am going to breed her to Dylan. This is a breeding for color and lines. Isis has a strong solid chocolate gene from her father who is out of Mishu lines that were acceptable to me. There were 3 solid chocolates in her litter she was the only solid black. I know that I will get some great looking puppies out of her and Dylan. With his red and her solid black and chocolate background I know there will be a good color choice from this pair of dogs. I can not guarantee a puppy by December but I will at least have something on the ground.

I was supposed to receive a puppy from Dawn Sandford of Heaven Sent Shih Tzus back in August. The puppy didn't make size for breeding. I was then offered another puppy out of a different breeding pair of shih tzus. I cannot get the puppy or the money back from Dawn because her friend Karen Christensen (aka Karen Foias, Karen Benjamin) wrote a false statement on www.ripoffreport.com about Myself and my kennel name under a false identity, oraiadora@yahoo.com

The following emails state this. I sent her one payment of $250.00 on April 30 of 2004, and a second payment of $250.00 on July 1, of 2004. I kept asking her for a contract, but didn't receive one until August 29, 2004 almost three months after I sent her my first payment. The following is what I understood our agreement to be (these are unedited emails between both of us):

I will put your money on a puppy out of Dylan and another b***h. I will sell you a puppy of equal value to the one that did not make size for that is stated in my contract that I do not give cash refunds. Since Dee Dee did not make size that was not my fault and you trash talking me to others was not my fault either. I am not a bad person and I always make good on all my dogs. I would like to talk to you about your breeding program and how you intend on breeding the girls and the way you plan to sell the puppies. I am extremely picky about who has my lines and I do not want to send you a puppy and have you ruin my lines that I have worked hard to get. I only wanted to help you out because you were new to the breeding but you did the one thing that new breeders should never do. You NEVER talk about the breeders that you are working with. I know too many other breeders and I can tell you that I always hear what is being said about me. I am in the process of settling things with Dawn of Mishu and I told her about the puppies that I had avialble with full registration and she did not want them. She wanted to wait and get a puppy out of Ikaika and Jewel. I told her that was fine and what ever she told you well that is her she likes to run her mouth also. I know alot about her and her dogs and after I send her the puppy I will not be getting anymore of her dogs and I am selling the ones that I have of hers. I can help you out alot or I can hurt you alot that is all up to you. I am a very nice and trusting person but I do not tolerate a back stabber I do not have time for that. I expect what I talk to you about to stay between me and you and that is the same with me I never tell what others say to me that is wrong and there is always 2 sides to every story. I have no reason to lie to any one. I no longer work for Jane Rich at Rich Kennels due to many many reasons. I learned some of what I know from her and the rest was what I learned on my own. I have a very bad temper and I had to wait and send you a note when i was no longer angry about trying to help you and you talking about me like I was trying to cheat you and keep Dee Dee for myself. I do not breed for the small size I breed for the standard and show size. That was very insulting to me that you would think that I was going to keep her and breed her when I told you that she would not make size. I will talk to you later. I am not going to talk with your husband about this for he is not the one that I am doing buisness with.

The next girl to be bred is Isis and I am going to breed her to Dylan. This is a breeding for color and lines. Isis has a strong solid chocolate gene from her father who is out of Mishu lines that were acceptable to me. There were 3 solid chocolates in her litter she was the only solid black. I know that I will get some great looking puppies out of her and Dylan. With his red and her solid black and chocolate background I know there will be a good color choice from this pair of dogs. I can not guarantee a puppy by December but I will at least have something on the ground.

I was supposed to receive a puppy from Dawn Sandford of Heaven Sent Shih Tzus back in August. The puppy didn't make size for breeding. I was then offered another puppy out of a different breeding pair of shih tzus. I cannot get the puppy or the money back from Dawn because her friend Karen Christensen (aka Karen Foias, Karen Benjamin) wrote a false statement on www.ripoffreport.com about Myself and my kennel name under a false identity, oraiadora@yahoo.com
I was emailed by Dawn and told she was not going to send me the puppy, and that she does not give cash refunds on deposits. I believe that Karen and Dawn both did this so that Dawn would not have to send me a puppy and not give me my money back. Since this has happened Dawn has posted a report on me that states that I do not own any of my dogs, or have them registered to me, and that I have bought and sold several. She is telling everyone that will listen that I only made a deposit and that the puppy was not paid for in full. The actual agreement was that I would put $500.00 dollars down and then I would breed the female with an approved male (approved came after I sent the money) and give her a puppy back. Run fast the other way even if you do not get your deposit back. However, since you did not see this contract before you gave your deposit, you might have a legal claim.
This contract should have been given to you and sign by you before you put any deposit down on the puppy and I don't think it would hold up in court If you have the dog already don't sign this contract if you have put a deposit down talk to a legal adviser and also talk with the breeder and tell her of your plan this is a very unreasonable contract and I would never agree to it

First of all, is this a joke? If it is, this is pretty funny. If not, this is the most outrageous document I have ever seen. I don't know you or your dogs, but if I had so little regard for you that I would want you to sign this, I would not sell you a dog in the first place! I would not sign something like this for any reason! It is TOTALLY OUTRAGEOUS!!! I wouldn't sign this if they were selling me Raggedy Andy himself!!!! There is NO dog on the planet earth that would be advantageous to you enough for you to sign this!
If it were me, I would DEMAND my money back and pretend I never met this person! I would NEVER buy a dog from this person.
It is illegal to present a contract to a person AFTER the money has changed hands and the deal is done. But I wouldn't buy the dog anyway if it was me.
Actually, it sounds to me like this person has been burned real bad and is now going to take it out on the world.
That's my honest opinion.
