The following letter was sent via email on 6/20/07 and 6/21/07 to jjacobs@dncinc.com He is the CEO and Chairman of Delaware North Companies very large concessionaires .

This was also sent to jlevesque@dncinc.com. He is the Vice President of Human Resources at DNC. Corporate phone number for DNC is 716-858-5251 Buffalo, NY Yosemite is 209-372-1230. Greg Johnson the Senior Union Rep can be reached at 290-372-1001 I was assured that the letter would be read by Marilynn (Jeffery Jacobs Executive Secretary). So far there has been no response of any kind from the DNC group.

RE: The Bait & Switch tactic of DNC-Yosemite
DNC-Yosemite employed me, Michael Warren Gates, from 4/24/07 to only 5/11/07. My file details, this, and what I am about to tell you much better than this brief summary. About 4/15/07 I was told that I was being hired for a Dispatcher position for the YTS shuttle system. Just before I moved to Yosemite I was told that I would not be able to start the Dispatcher job until 5/8/07. They said that I would need to be a Busser at Curry Village until the start date. I thought this was okay for a few days. My work history is quite extensive. You can look at my enclosed resume and see this.

On 5/4/07 I was told that there was no Dispatcher job for me. (I considered this a Bait & Switch tactic). On 5/3/07 I had called the Manager of Transportation and asked her if there was anyone or anything she wanted me to do before I started the Dispatcher job in five days. It was never explained why the Dispatcher position, that I was told that I was being hired for, was not available for me. There were two Dispatcher jobs one at Big Trees and one at YTS right after 5/3/07. These jobs were listed on the job board at Human Resources. From a fellow associate, someone who input data daily for Human Resources said that she had input over six hundred records of people that they had used this Bait & Switch tactic upon.

I was fired on 5/11/07 because I spoke to some students from Yosemite Institute training. They had asked me Why are you working here? After I had told them a little about my life to answer their question, they expressed an interest seeing my edited novel I am presently writing. It is titled The Fish Gambatte. I am a published author. Many people, of all ages, have given me their Email addresses so that they could see the novel draft.

I gave a list of email addresses I have collected from Mammoth Ski Area {my employer previous to Yosemite and Yosemite collection too. DNC Management knew that I talked before to the guests. I was never told to not to do this. In fact my GuestPath training told me this was the thing to do. Otherwise why would they have included the Seattle Pike Street Market Video in our training?

Greg Johnson, the Senior Union Representative, and I felt that it was very unfair that I was fired. Neither of us could understand what happened about the Dispatcher job either. I never got to have my three meetings. Neither of us has been able to find out the truth about any of the above. I never was allowed to have my third meeting even though I was told this was always allowed.

Perhaps the truth is that management at DNC-Yosemite did not like for anyone to complain about Bait & Switch and talking to the young students was an excuse in retaliation for complaints I had made about the Bait & Switch tactic. Frankly this Bait & Switch tactic hiring practice is unethical and maybe illegal.

One thing is for sure it is something that would be a published article for a newspaper or a web site. DNC has certainly had web pages made about it. The 1995 article in Backpacker magazine named

If a printed page is not applicable for Bait & Switch then I am sure that there are many web sites that would pick this up.

I have asked for an application for employment. I have been told that being fired by DNC does not mean that you cannot be hired again.

#1. You or your associates have never been fired before. If you had, your response would not have been so crass, nor would it have only taken only fifteen seconds that you took to compose this letter. It is also obvious to me
#2. That you did not investigate the charges that I made. They are A. That you are doing a Bate and Switch campaign, so that you can promise people anything; but, only give them what you want. B. As you are aware, a person cannot change jobs for one hundred and fifty days after he or she has taken a job with your company.
#3. You have had complaints about DNC before. I have listed two web sites in my first letter: Welcome to Hell is one the other is Searching the Earth for Cheap Labor. I guess you choose to ignore anyone who has a different point of view than yours. Management is trickle down. A good example of this is your Human Resources Department in Yosemite is so lax that they actually post jobs that have already closed. Your Human Resource Manager Suzie Gates (I am not related to her) actually gave to me a job listing that suited me very well. It had closed days before. She did not even apologize to me. This is business as usual at DNC (Does not Care or is it the Devil Needs Cash).

Once I again, I can say, your response to me was not unexpected. I can also say this. Your type of management will succeed until people find out what you are all about. It is my goal to make sure that many know about you and the way that you do business.
