I was looking for full time work as a massage therapist, and thought I was lucky to find a nice employer like Vlora. She didn't seem to have much business sense, but I figured it was a good opportunity to establish a clientele as the only full time therapist.

Although it was a small business it is in the heart of LINCOLN PARK, so it surprised me that she didn't keep HER business up to par, not even to the MINIMUM standards of cleanliness.

First I noticed the shortage of sheets, and at that they were STAINED SHEETS, gross. The owner (Vlora) told me it was okay because the room was dark (she had a red light in the massage room), plus the client would be face down most of the time, and if there were holes in the sheets "just put them by their feet". Then I saw the clouded, residue collecting, HAIR INFESTED, CONTAMINATED WAX. I was totally disgusted by her ethic.

I waited for the day a customer would discover what they were laying on and walk out. I decided to only use the best of her sheets, and had to remind her to wash them throughout the day so we'd have enough for the clients in the evening. Then the day came...

I came in to work and there were NO CLEAN SHEETS, I told the client we were running 30 min behind (because the sheets were still in the dryer), and then Vlora tells me to USE THE SAME DIRTY BOTTOM SHEET, "Just flip it over", and then to use the blanket for a top sheet...anyone who has common sense would never suggest this, it is not hygenic by any means. If anyone has ever received a massage they know most people are nude for the exception of the sheets and have full contact with the sheet they are laying on top of...no need to say more...absolutely disgusting.

Just as I thought it couldn't get worse my next two pay checks bounced. I called Vlora on her cell phone, of course no answer...it wasn't until I called and left several angry messages that she returned my call, only to have a nonchalant attitude saying she'd give me another check tomorrow...I quickly let her know that another check was not an option, I needed cash and I needed it on the next business day.

I got in touch will an ex-employee and found out that Vlora also bounced two of her checks and was avoiding her for the past four months. Unbelievable, but not surprising...

Now it is tax time and I never received anything from Vlora, so I called and the receptionist told me Vlora wasn't in and she had no idea when she'd be back. I told her it would be really ridiculous if Vlora was sitting there telling her to tell me she wasn't around, and I got the clue that I was being lied to. After a few hours I called back and was told Vlora was out of town, and no one knew when she'd be back....what a bunch of stupidity. I had to laugh at the childishness of this grown woman. So I called again and Vlora gets on the phone, she tells me I have no business calling, she doesn't report anything on her taxes, and not to call again...Two days later I get a message saying Vlora has my tax documents ready to be mailed out...

Vlora Kabashi definitely DOES NOT KNOW HOW TO RUN A BUSINESS, and unfortunately takes other peoples' kindness for granted. She steps over all of her employees, promising her receptionists hours she can't pay for, and her independent contractors a commission she can't budget in the first place.

Too bad, the area is great, but I feel for all those unsuspecting clients who are being ripped off in their services in a dirty "spa".

In my first sentence, Employer should be employee.

You were definitely an employee.

Fill out and mail the SS-8 form.

Employer will be penalized for non-compliance and will have to pay your entire SS tax [yours and thiers].

Tara,

Based on the information you provided already, you were legally an employer, NOT an independent contractor.

I will explain, but go to the IRS website and download and print the form SS-8 [Determination of Worker Status].

If a business owner provides you so much as a pencil to do your job, you are an employee.

Were you paying rent for your space?
Were you buying your own supplies?
Were you making your own schedule?

If you answered NO to ANY of the above questions, you were an employee which means that she needs to give you a W-2, NOT a 1099. AND, she needs to withhold taxes and match your SS contribution, AND have workman's compensation and unemployment insurance on you .

This is the law. File a complaint with the wage and hour division and the IRS.
, and SS administration. Also report her to workmans compensation for not having coverage on an employee. [You].

Keep in mind that just because someone calls you an independent contractor, does not make it so.

The law says that to be an independent contractor you must be able to provide services to anyone you choose [such as other salons] and you must have a monetary investment in the business and be able to sustain a loss.

Also, as an independent contractor, only you can set your work hours and no one can place any type of work rules on you, or any operational controls.

You were an employee. Make her comply.
